EXPORT AND IMPORT PERMITS ACT

Order Amending the Allocation Methods Order — Hatching Eggs, Live Broilers, Eggs and Egg Products

Whereas the Minister of Foreign Affairs has, pursuant to subsection 6.2(1) (see footnote a)  of the Export and Import Permits Act, determined the import access quantity for hatching eggs, live broilers, eggs and egg products;

Therefore, the Minister of Foreign Affairs, pursuant to paragraph 6.2(2)(a) (see footnote b)  and subsection 10(1) (see footnote c)  of the Export and Import Permits Act, hereby makes the annexed Order Amending the Allocation Methods Order — Hatching Eggs, Live Broilers, Eggs and Egg Products.

ORDER AMENDING THE ALLOCATION
METHODS ORDER — HATCHING EGGS, LIVE
BROILERS, EGGS AND EGG PRODUCTS

AMENDMENTS

1. The definition "applicant" in section 2 of the Allocation Methods Order — Hatching Eggs, Live Broilers, Eggs and Egg Products (see footnote 1)  is replaced by the following:

"applicant" means a resident of Canada who applies for an import allocation and includes a hatchery that is not a corporation whose owners are residents of Canada and apply for an import allocation. (requérant)

2. The definition "market share" in section 3 of the Order is replaced by the following:

"market share" means, in relation to a hatchery that is an applicant and in relation to the 12-month period ending on September 30 in the calendar year before the calendar year for which the import allocation is to apply, the hatchery's percentage share of the total number of hatched hatching eggs among those hatcheries that are applicants. 3. The definition "market share" in section 5 of the Order is replaced by the following:

"market share" means an applicant's share of the total number of eggs or egg products, as the case may be, sold by all applicants for an import allocation for eggs or egg products, as the case may be, during the 12-month period ending on September 30 in the calendar year before the calendar year for which the import allocation is to apply. COMING INTO FORCE

4. This Order comes into force on the day on which it is registered.
