Description:
If, while serving a sentence in a federal penitentiary, an inmate is injured as a result of an accident, while participating in an approved program, i.e. work activities or training program, the inmate may be entitled to benefits similar to workers' compensation.
An inmate who is injured as a result of an accident must report the incident to the Correctional Services within three months of the occurrence and submit an application for compensation to Human Resources and Social Development Canada - Labour, before release from the institution on full parole, at the expiration of sentence or on statutory release.
The benefits payable are the cost of medical care and a monthly or lump sum disability payment. The amount awarded reflects the degree of disability remaining after the inmate is released. Payments are made only after an inmate is released from the penitentiary upon completion of the sentence, on statutory release, or on full parole.
In the case of an accident-related death, benefits are available to qualifying dependants.
