Access to Information &
Protection of Privacy
Yukons Access to Information and Protection of Privacy Act ("the
ATIPP Act") provides individuals with a formal method of requesting information held
in Yukon government departments. Under the ATIPP Act individuals can also request
corrections to their own personal information contained in Yukon government records.
These requests are facilitated by the Department of Highways and Public Works (the
responsibility was transferred from the Department of Education to the Department of
Highways and Public Works on April 1, 2002 as part of the Yukon governments Renewal
initiative).
The Department of Highways and Public Workss corporate ATIPP office staff will
provide assistance, if required, in the preparation of ATIPP requests. For applications
forms (Request for
Access for Records Form or
Request for
Correction of Personal Information Form ) and other assistance contact
the Department of Highways and Public Works at (867) 393-7048 or toll-free within the
Yukon at 1-800-661-0408 local 7048.
Once an application is processed, government departments have 30 days to respond to the
request.
Please note that the ATIPP directory is under review.
What does the law do for me?
This law:
- Guarantees you access to Yukon government records with certain exceptions;
- Guarantees you access to your own personal information in Yukon government records;
- Gives you the right to ask for corrections to your own personal information in Yukon
government records, if it is not accurate.
This law also:
- Prevents other people from seeing information about you without your permission;
- Prevents your personal information from being collected, used or made public without
authorization;
- Provides for an independent review of decisions about disclosure of information,
possible violation of individual privacy, correction of personal information, extension of
response time and waiver of fees.
What does the Act cover?
- The Act applies to all public bodies, that is, all the departments, corporations and
agencies of Yukon government;
- It does not apply to the Yukon Legislative Assembly, Yukon courts, Yukon College, Yukon
Hospital Corporation, and some boards and committees (including boards and committees
established under Land Claims legislation).
Will I need to make use of the Act?
Rarely.
We believe in:
- open government; and
- your right to know about most of the things we do.
When you need information, contact the appropriate government department or agency to
make a request.
What records can I ask to see?
- Personal information about you;
- Files, letters, agreements, microforms and computer records dealing with all aspects of
government operations.
What records can't I see?
Certain types of records are protected, such as
- Personal information about other individuals;
- Information that could cause a person or a government body to make or lose money;
- Information that could be a threat to public safety;
- Information that could interfere with law enforcement; and
- Cabinet records for up to 15 years.
What can I do if my request is turned down?
You can make a formal application by filling out and submitting an Access to Information
and Protection of Privacy form to the Department of Highways and Public Works.
How long will it take to get a response to my application?
- Within 30 days of the receipt your request, in most cases;
- More that 30 days if
- a third party is affected by the request; or
- your request is not clear or requires additional search or preparation time.
You will be notified of any delay.
What can I do if my application is turned down?
If your application is refused or partly refused, you can:
- Request a review of the decision by the Information and Privacy Commissioner, who will
make a recommendation to government.
- Appeal to the Yukon Supreme Court if you do not agree with the Commissioner's
recommendation or it is not accepted by the government. The Court can order the release of
information if it rules in your favour.
How much will it cost me?
- There is no charge for applying for information;
- You will be charged for:
- search and preparation time longer than three hours;
- making copies of records;
- you may request a waiver of fees if paying all or part of the fees would be an undue
financial burden for you.
- You will be given an estimate of the cost in advance.
How can I ensure that information about me is correct?
- Ask to see your personal information;
- Apply in
writing
to have the
information changed if you believe there are errors;
- Your information will be added to the record; and
- Others who have seen your records will be informed of the new information.
