Employment Standards Act - Payroll Regulations

Most employees in Manitoba fall under provincial jurisdiction and are covered by the Employment Standards laws in Manitoba which promote fairness in the workplace for employers and employees.  Payroll records must be produced to an Employment Standards officer upon request.

Summary

EMPLOYER PAYROLL RECORDS REQUIREMENTS

Every employer shall maintain in his/her principal place of business in the province a true and correct record of the following:

  1. The hours worked or on duty each day, showing overtime hours separately.
  2. The rate of wages at which the employee is employed.
  3. The dates upon which wages have been paid to each employee.
  4. The amount paid on each such occasion.
  5. The amount of each deduction made from wages and the particulars thereof.
  6. The date of commencement of present term of employment.
  7. The date and particulars of each change in rate of wages.
  8. The name, last known address and occupation of the employee.
  9. Where an employee works or is on duty on a general holiday, the rate of wages paid therefore.
  10. Each annual vacation granted showing:
    1. The date of commencement and the date of completion of the vacation.
    2. The period of employment in respect of which the vacation was given.
    3. The amount of vacation pay given and the date upon which it was paid. 
    4. The amount of money paid in lieu of an annual vacation upon termination of employment and the date of such payment.
  11. The date when employment ceases.

PAY STATEMENTS FOR EMPLOYEES

Employers must furnish to each employee a written statement at the time of paying wages showing the hours paid for, the rate of pay, the overtime hours, the deductions, if any, and the net amount paid to the employee.

FREQUENCY OF PAYMENT

The Payment of Wages Act requires an employer to pay an employee salaries, commissions or any compensation for labour due to that employee, less any legal deductions made by the employer, at least semi-monthly (twice per month)

EMPLOYEE PAYMENT DEDUCTIONS

Only those deductions authorized by law or specifically consented to by the employee are allowed. This does not include a right to offset any monies for shortages, damages, or anything not consented to by the employee. The employer may take civil or criminal action, whichever is appropriate under law, to recover any loss.

EMPLOYMENT TERMINATION PAYMENTS

Employers have five calendar days from the date of termination of employment to pay all outstanding wages, or five working days from the completion of the pay period if termination has not taken place, to pay outstanding wages.
