To Whom Does This Apply?
Employers
Summary
Standard hours of work are 8 hours per day, 40 hours per week. Exceptions can be made through collective (union) agreements or by applying and being granted permission to extend or change these hours by the Manitoba Labour Board by virtue of an Hours of Work Order.
OVERTIME
All overtime is voluntary. Employees cannot be forced to work beyond their standard hours of work unless a state of emergency has been declared by the Lieutenant Governor in Council. All hours worked beyond standard hours of work must be paid at a rate of 1½ times the employee's regular rate of pay. This may not apply if an Hours of Work Exemption Order has been obtained by the employer from the Manitoba Labour Board. The employer must authorize overtime, that is, overtime has to be at the request of, or with the permission or knowledge of, the employer.
Exception: Excluded from overtime are travelling sales people who are employed on an incentive basis, or who regularly travel more than 10 miles (16 km) in a day in the course of their duties.
