The following is intended to provide an understanding of potential licence, permit or registration requirements when considering the establishment of a Campground in New Brunswick. This document is a guide prepared by the Canada / New Brunswick Business Service Centre and affiliated departments and agencies to provide you with a list of possible steps and issues to consider in carrying out your project. The extent to which the information will apply to you is dependent on the circumstances related to your project.

1.  Definition of campgrounds
Campgrounds are defined as establishments providing an area of land, other than a mobile home park, where trailers, camper trailers, tents, camping trucks, motor homes and / or similar shelters are placed for the purpose of providing temporary sleeping accommodations.

2.  Tourism Establishment Licence
The development and operation of all establishments providing overnight sleeping accommodations to the traveling public, including campgrounds, is governed through the licencing requirements according to the Tourism Development Act and Regulations. The licence is called the Tourism Establishment Licence.

The procedure to obtain a licence is as follows:

A licensing application form must be completed and returned, together with the applicable licensing fee, to the New Brunswick Tourism Grading Inc. (see section 6). It is important to ensure that the required conditions for licensing have been met prior to submitting an application, as the licensing fees are non-refundable.

Following receipt of the completed application form and fee, a licensing inspection of the establishment is scheduled by the New Brunswick Tourism Grading Inc. Once it has been verified that the minimum standards according to the Tourism Development Act and Regulations have been met and / or exceeded, New Brunswick Tourism Grading Inc. forwards a recommendation to the Department of Tourism and Parks that the campground be approved for a Tourism Establishment Licence.

A Tourism Establishment Licence must be renewed annually, with the deadline being each July. Full remittance of the combined licencing/rating fee plus HST, (per the fee schedule) must be received by July 31st of each year in order for the establishment to be listed in the provincial publications for the following year.

3.  Regulations
In addition to meeting the requirements under the Tourism Development Act and Regulations, and depending upon the circumstances, approvals may also be required from the following Departments:

3.1  Department of Transportation - Access Permit
Certain roads and highways throughout the province may have restricted or limited access. Prior to development, particularly in unincorporated areas, the District Engineer responsible for the area in which the proposed campground will be located must be contacted for access and setback approval. An Access Permit is required from the Department of Transportation.

3.2  Department of Health
Approval from Public Health 506-453-2830, Department of Health, is required with the exception of campgrounds within a municipality that are connected to an approved water and sewage system.

If you will be preparing and serving foods, you will need a Food Service Establishment Licence. Look under Public Health Services in the provincial section of the blue pages of your telephone directory for your nearest office.

3.3  Department of Local Government - Construction
Approval from the Department of Local Government is required prior to the construction of buildings and or campgrounds in an unincorporated area. For more information, contact your Local District Planning Commission (area code 506):

3.4  Municipalities
Establishment of a campground in a municipality must receive municipal approval prior to operating to ensure that zoning and other requirements are met. 3.5  Department of Public Safety
Building standards, electrical installation, plumbing, etc. are subject to approval by the Department of Public Safety.

The Office of the Fire Marshal is also with this Department. New developers are advised to contact the Fire Marshal to determine if a fire inspection is required.

3.6  Department of Environment - Installation
Large installations such as lagoons and sewage treatment plants require approval by the Department of Environment. For additional information, you can call the Department of Environment at 506-444-3635 or contact your local office.

4.  Protection of Personal Information: Your Responsibilities
The Guide to Canada 's Personal Information Protection and Electronic Documents Act (PIPEDA) helps businesses understand their obligations and comply to the Act. Since January 1, 2004 , the PIPED Act covers the collection, use or disclosure of personal information in the course of all commercial activities in Canada , except in provinces which have enacted legislation that is deemed to be substantially similar to the federal law.

5.  Campground Rating Program (Camping Select)
The Program is based upon a two-tier system, reflecting separate facility and recreation scores. All scores begin at a (1) star level and increase in (½)  star increments to a maximum of (5) stars. Higher star levels are achieved as facilities, services, quality, amenities and recreational items and services increase.  What the stars mean:

1* star 

If you are seeking clean comfortable campgrounds without the extras;

2** and 3*** stars

Mid-range standard of campground facilities or recreation with various
services and amenities.

4**** and 5***** stars

Greatest range of services, amenities, recreation or facilities.

In addition to the required approvals as mentioned in section 3 above, all campgrounds must meet and / or exceed the minimum standards required for the Canada Select (1) star rating as required under the Tourism Development Act. The inspections for licensing are carried out by New Brunswick Tourism Grading Inc., on behalf of the Department of Tourism and Parks.
