1. Section 606 of the Criminal
Code is amended by adding the following after subsection (4):

(4.1) The definitions in this subsection apply in this
section.
“Attorney General” means the Attorney
General of Canada.
“serious
offence” has the same meaning as in subsection 467.1(1).

(4.2) Notwithstanding any other provision of this Act,
where an accused or defendant pleads guilty of the offence charged but not
guilty of a serious offence arising out of the same transaction, whether or
not it is an included offence, the court may, with the written consent of the
Attorney General, accept that plea of guilty and, if the plea is accepted,
the court shall find the accused or defendant guilty of the offence charged
but not guilty of the serious offence and enter those findings in the record
of the court.

(4.2) Malgré les autres dispositions de la
présente loi, le tribunal peut, avec le consentement écrit du procureur
général du Canada, accepter le plaidoyer de culpabilité de l’accusé ou du
défendeur qui, tout en avouant sa culpabilité à l’égard de l’infraction dont
il est inculpé, nie sa culpabilité à l’égard d’une infraction grave se
rapportant à la même affaire, qu’il s’agisse ou non d’une infraction incluse
et, si ce plaidoyer est accepté, le tribunal doit déclarer l’accusé ou le
défendeur coupable de l’infraction dont il est inculpé, le déclarer non
coupable de l’infraction grave et consigner ces déclarations au dossier du
tribunal.

(4.3) No
proceedings shall be commenced under subsection (4.2), unless the prosecutor
first obtains the written consent of the Attorney General.

(4.4) The Attorney General shall take into account the
public interest before giving the
consent referred to in subsection (4.3).

(4.5) The Attorney General shall prepare and cause to be
laid before Parliament an annual report for the previous year on the
operation of subsection (4.2).

l’application du paragraphe (4.2) au cours de l’année précédente.
