Guidelines for Preparing the Electronic Copy of a Factum on Appeal or Cross-Appeal

General

  • Electronic factums are for internal court use only and will not be made available through the Court's Internet site.

  • Counsel are now required to file their appeal and cross-appeal factums (with the exception of Part VII) in both electronic and hard copy formats, as follows:

    (1) a PDF (Portable Document Format) file on CD-ROM; and
    (2) a paper original together with 23 paper copies.

  • The electronic copy must be on CD-ROM and must not be sent by e-mail.

  • The CD-ROM must be filed at the same time as the paper copies. If the CD-ROM contains information subject to a sealing order it must be filed in a sealed envelope clearly marked as sealed.

  • The CD-ROM must be labelled with at least the party’s name and the SCC file number. If space permits, the style of cause should also be included.

  • If changes are made to the paper copy of the factum, a new CD-ROM must be concurrently filed.

  • Counsel may provide other appeal documents in PDF format at their discretion. These should be on a separate, clearly labelled CD-ROM.

  • The Court cannot provide technical support for the production of the PDF file or CD-ROM. However, questions on the process may be addressed to Etienne Perras, Manager, Court Records Office, at (613) 992-7891 or perrase@scc-csc.gc.ca.

Producing the PDF document

  • The paper original, which must be signed by counsel of record, is the official record. The electronic version must be saved in one electronic file and must be a true representation of the paper version. Only the paper version must include the signature of counsel at the end of Part V.

  • The Court requires the PDF document to be an optical character recognition (OCR) document. Any other type of PDF document will not be accepted.

  • Set the resolution to 300 dpi.

  • Create bookmarks for documents that have a Table of Contents (TOC). The bookmarks should mirror the items in the document’s TOC.

  • In the case of a document divided into multiple volumes, each volume should have bookmarks to reflect its content as indicated in the TOC.

  • Deactivate any security settings, because they may interfere with systems for the visually impaired and affect accessibility.

  • Do not link to external sites or to other filed documents. Linking inside a given document is optional.

  • Avoid using the following characters in file names: ` ~ ! @ # $ % ^ & * () + = [] {} : ; ' , ? | " /

  • Use the Court file number in the file name when saving your document.
