1. (1) Subsection 16(3) of the Divorce
Act is replaced by the following:
|
|

Application by other person
|
(3) A person, other than a spouse or a
parent of a spouse, may not make an application under subsection (1) or (2)
without leave of the court.

la mère de celui-ci, doit obtenir l’autorisation du tribunal.

(9) In making an order under this
section, the court shall not take into consideration the past conduct of any
person unless the conduct is relevant to the ability of that person to act in
the best interests of the child.

(10) In making an order under this
section, the court shall give effect to the principle that a child of the
marriage should have as much contact with each spouse and each parent of a
spouse as is consistent with the best interests of the child and, for that
purpose, shall take into consideration the willingness of the person for whom
custody or access is sought to facilitate such contact.

(10) En rendant une ordonnance conformé-ment
au présent article, le tribunal applique le principe selon lequel l’enfant à
charge doit avoir avec chacun des époux, et chacun des père et mère de
ceux-ci, le plus de contact compatible avec son propre intérêt et, à cette
fin, tient compte du fait que la personne pour qui la garde ou l’accès est
demandé est disposée ou non à faciliter ce contact.

(9) In making a variation order varying
a custody order, the court shall give effect to the principle that a child of
the marriage should have as much contact with each former spouse and each
parent of a former spouse as is consistent with the best interests of the
child and, for that purpose, where the variation order would grant custody of
or access to the child to a person who does not currently have custody or
access, the court shall take into consideration the willingness of that
person to facilitate such contact.

modificative d’une ordonnance de garde, le tribunal applique le principe
selon lequel l’enfant à charge doit avoir avec chacun des ex-époux, et chacun
des père et mère de celui-ci, le plus de contact compatible avec son propre
intérêt et, si l’ordonnance modificative doit accorder la garde ou l’accès à
une personne qui ne l’a pas actuellement, le tribunal tient compte du fait
que cette personne est disposée ou non à faciliter ce contact.

3. (1) On the expiration of three
years after its coming into force, this Act shall be referred to such
committee of the House of Commons, of the Senate or of both Houses of
Parliament as may be designated or established for the purpose of reviewing
its provisions and operation.

3. (1) À l’expiration du délai de
trois ans suivant son entrée en vigueur, la présente loi est soumise à
l’examen du comité soit de la Chambre des communes, soit du Sénat, soit
mixte, désigné ou constitué pour examiner ses dispositions et son
application.

(2) The committee designated or
established for the purposes of subsection (1) shall undertake the review
referred to in that subsection and, within six months after the review is completed
or within such further time as the House of Commons may authorize, shall
submit a report to Parliament thereon, including its recommendations as to
whether the provisions of this Act should be continued or changed and
specifying any changes it recommends.
|
|
(2) Le comité procède à l’examen
visé au paragraphe (1) et, dans les six mois après l’avoir terminé ou dans le
délai supérieur autorisé par la Chambre des communes, remet son rapport au
Parlement, en l’assortissant de ses recommandations quant au maintien en
vigueur des dispositions de la présente loi et, le cas échéant, aux
modifications à y apporter.
