1. The Criminal Code is
amended by adding the following after section 355:

Possession or transfer of identifying information
|
355.1 (1) Every one commits an offence who, without lawful excuse, has
in his or her possession or transfers any information that can be used to
identify a person other than him or her.

(2) Every one commits an offence who,
without lawful excuse, has in his or her possession or transfers a document
appearing to be issued for the purpose of identifying a person other than him
or her, including a credit card, a birth certificate, a passport, a driver’s
licence or a health insurance card.

(2) Commet une infraction quiconque a en
sa possession ou transfère, sans excuse légitime, un
document — notamment une carte de crédit, un certificat de
naissance, un passeport, un permis de conduire ou une carte d’assurance-maladie — paraissant
avoir été délivré pour servir à identifier quelqu’un d’autre.

(3) Every one who commits an offence
under subsection (1) or (2) is guilty of an indictable offence and liable to
imprisonment for a term not exceeding ten years.

(3) Quiconque commet une infraction
visée aux paragraphes (1) et (2) est coupable d’un acte criminel et passible
d’un emprisonnement maximal de dix ans.
