The following is intended to provide an understanding of potential licence, certification, permit or registration requirements when considering the establishment of a Landscaping business in New Brunswick. This document is a guide prepared by the Canada / New Brunswick Business Service Centre and affiliated departments and agencies to provide you with a list of possible steps and issues to consider in carrying out your project. The extent to which the information will apply to you is dependent on the circumstances related to your project.

1.  Regulations

1.1  Pesticide Applicator's Certificate
Any individual wishing to apply a pesticide must obtain a Pesticide Applicator's Certificate and renew it yearly. (The only exception is homeowners using domestic pesticides on their own property.) This Certificate is proof that the individual has received the necessary education and training to carry out pesticide applications in a safe and responsible manner. There are certification training programs for all types of pesticide application programs (i.e. training is available for professional lawn care, structural pest control and agricultural use). 1.2  Watercourse and Wetland Alterations
If removing, depositing, or disturbing soil or vegetation in and/or within 30 metres of a watercourse or wetland, e.g. retaining walls, bridges, culverts, etc., you must obtain a permit under the Watercourse and Wetland Alteration Regulation - Clean Water Act. The permitting of alterations is administered under this Act. Contact the provincial Department of Environment at 506-453-2690.

1.4  Protection of Personal Information: Your Responsibilities
The Guide to Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) helps businesses understand their obligations and comply to the Act. Since January 1, 2004, the PIPED Act covers the collection, use or disclosure of personal information in the course of all commercial activities in Canada, except in provinces which have enacted legislation that is deemed to be substantially similar to the federal law.
