Labour Standards in the Federal Jurisdiction Workplace

To Whom Does This Apply?

These are businesses and organizations whose main activities include:

• railways, road transport, ferries, canals, tunnels, and bridges that extend beyond the border of a province or Canada;
• air transport, aircraft operations, and aerodromes;
• shipping and shipping services;
• telephone, telegraph, and cable systems;
• radio and television broadcasting;
• banks;
• pipelines;
• most grain elevators; flour and seed mill, feed warehouses and grain-seed cleaning plants;
• uranium mining and processing; and
• most federal Crown corporations, such as Canada Post Corporation and Canada Mortgage and Housing Corporation.

Summary

Part III of the Canada Labour Code provides some standards for employment in a federal jurisdiction workplaces The Code includes standards relating to:

• minimum wages;
• General Holidays;
• Annual Vacations;
• maternity-related reassignement leave, maternity leave and parental leave;
• Sick Leave and Work-Related Illness and Injury Leave;
• Bereavement Leave;
• Unjust Dismissal - Mediation Process;
• Hours of Work;
• Hours of Work - Motor Transport;
• Termination of Employment;
• Wage Recovery; and
• Sexual Harassment.

The Canada Labour Standards Regulations modify certain provisions of the Code for all employment in the federal jurisdiction. The other related Regulations modify certain provisions of the Code only for the particular industry or occupation named in the Regulation title.

Labour Program District offices are responsible for monitoring employer establishments to enforce the Code and for investigating individual complaints when employers have not complied with the Code.
