To Whom Does This Apply?

The Occupational Health and Safety Act of Alberta requires every employer, under provincial jurisdiction, to ensure, as far as is reasonably practicable, the health and safety of workers. The Act does not apply to farming and ranching, domestic workers and persons working at home.

Summary

The provisions of appropriate Occupational Health Services by the employer would be part of this requirement. Alberta Human Resources and Employment, Workplace Health and Safety (WHS), monitors compliance with the Act, associated regulations and code and provides advice and direction as needed.

The Occupational Health and Safety Act, Regulation and Code cover approximately 106,000 employers in Alberta. Typically, WHS serves employers, workers, worker representatives (labour union etc.), industry associations, and health / safety professionals.

WHS provides occupational health and safety information to Albertans in a variety of ways including telephone inquiries, library services (reference and audio-visual materials), requests for technical information, publications, and WHS web site.

WHS enforces the Occupational Health and Safety Act, Regulation, and Code:

  • Albertans can notify the department of hazards at a worksite. WHS officers have the right to enter and inspect worksites to enforce the Act.
  • A WHS officer can order work stopped or call for immediate corrective actions if the officer believes a worksite is dangerous.
  • WHS receives notification of serious incidents and fatalities. WHS Officers investigate and prepare reports on these incidents.
  • WHS can recommend a prosecution of an employer or worker if evidence reveals a significant failure to follow regulations.
  • WHS targets inspections for industries and employers with poor occupational health and safety performance.
  • Through the Partnerships Program the department also works with industry associations and large employers to audit and certify health and safety programs at worksites. This is a voluntary program. The Partnership Program can be reached at (780) 427-8842.
