Fisheries and Oceans Canada is proposing to amend the
Pacific Fishery Regulations, 1993 and the Fishery
(General) Regulations. These amendments will update and
expand the schedule of ticketable provisions in the Fishery
(General) Regulations and create a schedule of ticketable
provisions for the Pacific Fishery Regulations, 1993.
Consultations on these amendments took place during the spring
and summer of 2004. A summary report is available below.
Fisheries and Oceans Canada is committed to the increased use
of tickets as an enforcement tool. Currently, when a Fishery
Officer encounters an individual/corporation committing an
offence under most provisions of the Fishery (General)
Regulations or under the Pacific Fishery Regulations,
1993 and the officer determines that a charge is
warranted, he/she must issue an appearance notice compelling
the accused to appear before a Provincial Court judge.
Tickets will provide an alternative to appearance notices and
will also allow individuals/corporations the option of
entering a guilty plea without spending the time and money
necessary to attend court. Tickets have been used in British
Columbia recreational fisheries for many years.
