What happens after my CPP appeal has been allowed by the Review Tribunal?

A5.1

There is a 90 day appeal period during which all parties may request a leave to appeal to the Pension Appeals Board. If there is no appeal the payment is issued by SDC. Contact SDC at their toll free number (1-800-277-9914 for service in English and 1-800-277-9915 for service in French) for further information.

Q5.2
I think that the decision from SDC discriminates against me. What do I do?

A5.2

SDC's decision is based on its interpretation of the relevant legislation - the Canada Pension Plan or the Old Age Security Act. A person who claims the decision discriminates against them is usually challenging the legislation under which the decision was made. Most people who claim the legislation is discriminatory find it useful to have professional assistance.

There are specific procedural requirements for appeals involving the Canadian Charter of Rights and Freedoms. For example, the notice of appeal must contain a statement of the facts, issues, statutory provisions, reasons and evidence to be relied upon. As well, the Attorney General of Canada and of each of the provinces and territories must be given notice according to the requirements of section 57 of the Federal Court Act. Proof of service of the notice must be given to the Commissioner of Review Tribunals no later than 7 days before the Review Tribunal hearing date.
