Independent Logging Contractor Fined for the Deposit of a Deleterious Substance

Thunder Bay, Ontario - On April 15, 2005, Jerimy Erickson of Thunder Bay, Ontario was fined $3,500 and ordered to prevent the further deposit of a deleterious substance into a tributary to the McIntyre River and ordered to restore the area after being found guilty to one count of violation of Section 36(3) of the Federal Fisheries Act for &#34deposit of a deleterious substance". The offence occurred in Gorham Township on a small tributary stream to the McIntyre River.

Trout Unlimited Canada is to receive $3,000 of the fine for the Coaster Brook Trout Habitat Research Program on the north shore of Lake Superior.

On May 4, 2004, the Ontario Ministry of Natural Resources (OMNR) received a complaint about the McIntyre River below Johnson Lane on Dog Lake Road. Upon investigation it was determined that logging equipment had been crossing a small tributary stream to the McIntyre River, causing sediment release into the creek. In accordance with the interim Compliance Protocol Agreement, this file was turned over to DFO enforcement staff for the completion of the investigation and prosecution.
