Information on the New Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations


What are these Regulations all about?

The Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations (EIHWHRMR), under the Canadian Environmental Protection Act, 1999 (CEPA 1999), control and track the movement of hazardous waste and hazardous recyclable material between Canada and other countries.


Do the Regulations apply to me?

The Regulations apply to all individuals and businesses that export from, import into, or transit Canada, for recycling or disposal purposes, wastes or materials that are considered to be hazardous under the EIHWHRMR. Included are, for example, generators, receivers, carriers, brokers, agents, and transfer stations.


What are “hazardous wastes” and “hazardous recyclable materials”?

Hazardous wastes (intended for disposal) and hazardous recyclable materials (intended for recycling) are defined by taking into account the hazard criteria established under the Transportation of Dangerous Goods Regulations (TDGR) as well as specifically listed wastes and materials in the Schedules of the EIHWHRMR.

IT IS YOUR RESPONSIBILITY TO IDENTIFY AND PROPERLY CLASSIFY YOUR WASTE AND RECYCLABLE MATERIAL ACCORDING TO THE REGULATIONS.

Steps for Exporting, Importing or Transiting Hazardous Wastes and Hazardous Recyclable Materials

If the waste or material you intend to export, import, or transit, meet the EIHWHRMR definition of hazardous waste, or hazardous recyclable material, it is your responsibility to:

  1. Complete a Notice as required by the EIHWHRMR and available from the Transboundary Movement Branch of Environment Canada.
  2. Have a signed written contract between the generator and receiver of the hazardous waste or hazardous recyclable material as required under the EIHWHRMR (exports and imports only) and ensure that the Canadian importer or Canadian exporter (as the case may be), and all carriers have valid insurance coverage as required under the EIHWHRMR.
  3. Obtain a Permit issued by the Minister of the Environment for the export, import or transit of hazardous waste or hazardous recyclable material before proceeding with any shipments between the valid dates set out in the Permit.
  4. Ensure that the Movement Document is correctly completed, signed and accompanies each approved shipment of hazardous waste or hazardous recyclable material entering or exiting Canada.
  5. Ensure that the quantity in the shipment does not exceed the quantity provided and approved in the Permit.
  6. Ensure that the carrier is an authorized carrier and that the recycling or disposal facility is certified to accept the hazardous waste or hazardous recyclable material.
  7. Comply with all requirements of the Transportation of Dangerous Goods Regulations (TDGR) during the movement of the hazardous waste or hazardous recyclable material, where applicable.
  8. Ensure that a copy of the Movement Document as well as a copy of the Permit are provided to the carrier(s) and that both are dropped off at the port of entry/exit to a Canadian Border Services Agency (CBSA) agent.
  9. Submit copies of the completed Movement Document and certificate of recycling/disposal to Environment Canada to fulfill your obligations under the EIHWHRMR.
  10. Retain the Movement Documents at your place of business in Canada for three years following the completion of the movement

IT IS YOUR RESPONSIBILITY TO FOLLOW THE RULES AND TRANSPORT YOUR HAZARDOUS WASTE OR HAZARDOUS RECYCLABLE MATERIAL ACCORDING TO THE REGULATIONS.
