To Whom Does This Apply?

All persons importing goods under the North American Free Trade Agreement (NAFTA) or the Canada Chile Free Trade Agreement (CCFTA) and the Canada Israel Free Trade Agreement.

Summary

The Customs Act governs the administration and enforcement of customs laws.

Under the Customs Act, the Canada Border Services Agency (CBSA) must determine, and importers must prove, the origin of goods imported from a NAFTA country, Chile, Israel or another CIFTA beneficiary. Section 59 of the Act allows an officer to review a determination under a prescribed period of time as set out in regulations.

The Determination, Re-determination and Further Re-determination of Origin, Tariff Classification and Value for Duty Regulations permit re-determinations of origin for a period of up to five (5) years in certain circumstances.  Otherwise the re-determination period is at any time within four (4) years after the date of the initial determination of origin.
