Transportation of Dangerous Substances Regulation  

This Web site provides information on the Transportation of Dangerous Substances Regulation that the ministère des Transports du Québec administers. The information on this site must not give rise to a legal interpretation of the Regulation and in no way discharges carriers and consignors from their obligation to be aware of and comply with standards governing their operations.

The provisions in the Transportation of Dangerous Substances Regulation are now harmonized pursuant to Québec’s powers and jurisdiction in respect of road transportation with provisions in the Transportation of Dangerous Goods Regulations adopted by the federal Department of Transport. The elaboration of the Regulation stems from close collaboration between the provincial and federal governments and representatives of the industry concerned.

The Regulation governs the handling and transportation of dangerous substances on Québec roads from the place of manufacture or distribution to the place of delivery or unloading. In some instances, it provides for exemptions depending on the type or quantity of dangerous substances in question.

Moreover, the transportation of dangerous goods is subject to the regulations of the International Maritime Organization (IMO), the International Civil Aviation Organization (ICAO) and US regulation CFR 49. In the case of intermodal or cross-border transport, the carrier must ascertain whether the dangerous goods are subject to the regulations and, if need be, to what extent.

It is essential to comply with safety rules governing the transportation of dangerous goods.

In order to simplify the text, we have used the term “carrier,” which includes the notion of “operator.”

It is prohibited to use a road train with an overall length of more than 25 m or a type A or C double train to transport dangerous substances.

Transport to the United States

All carriers of dangerous substances destined for the United States must obtain each year a permit issued by the United States Department of Transport (USDOT).

The dangerous substances covered have the following characteristics:

Dangerous substances identification placard - Class 7. Any quantity of Class 7 radioactive materials;
Dangerous substances identification placard - Class 1.1. Over 25 kg of Classes 1.1, 1.2 or 1.3 explosives;
Dangerous substances identification placard - Class 2.3. Over 1 litre of products that are toxic through inhalation;

They require the display of placards.

Any carrier of dangerous substances to be transported to the United States must be able to prove that all of his employees have received adequate training in the transportation of dangerous substances.
