Act to amend the Transport Act as regards bulk trucking

The Act to amend the Transport Act as regards bulk trucking sets down rules governing bulk trucking as of January 1, 2000. (Text of the Act (1999, chapter 82)

Deregulation of the trucking industry

The Act deregulates the Québec bulk trucking industry, in line with the agreements on free trade. As of January 1, 2000, bulk trucking permits and regulated tariffs will be abolished for all sectors, the following in particular:

  • Supply of processing plants (e.g., table salt, concrete sand, mineral ore);
  • Private sector transport (e.g., construction of houses and shopping centres, snow removal by municipalities that do not have preferred hiring clauses);
  • Transport of forest products (e.g., wood chips, logs from private woodlots).

Maintenance of preferred hiring clauses

The Act maintains the preferred hiring clauses provided for in road building and repair contracts awarded by the ministère des Transports du Québec for a seven-year period. This framework may also apply to municipalities which agree to adopt preferred hiring contracts. The choosing of truckers to provide these bulk trucking services will be the responsibility of the brokerage permit holder. These permits will remain regulated.

Regulations

In order to terminate the implementation of the new bulk trucking framework, the Québec government made the following four regulations:

Regulation respecting the brokerage of bulk trucking services

This Regulation applies to the brokerage of bulk trucking services in public contracts for the transport of sand, earth, gravel, stone, concrete other than in a concrete mixer truck, bituminous concrete including planed asphalt and recyclable and non-recyclable asphalt, materials resulting from road demolition, snow, ice and salt intended for road maintenance. Regulation to amend the Vehicle Load and Size Limits Regulation

The Vehicle Load and Size Limits Regulation was amended in 1998 in order to eliminate all load increases provided for in regard to certain axle groups and the total loaded mass for the following vehicles:

  • single unit road vehicles equipped with a non-detachable dumping mechanism carrying sand, earth, gravel, stone, sodium chloride, snow, ice or hot mix asphalt;
  • back loading refuse-compacting trucks;
  • single unit road vehicles assigned to snow removal and de-icing on public highways; and
  • single unit road vehicles assigned to maintenance of public highways when the vehicle model year is prior to 1992.

For these vehicles, the maximum load on the rear tandem axle (class B.21) has been reduced from 20 000 kg to 18 000 kg. Consequently, the maximum total loaded mass for these vehicles, with the exception of vehicles assigned to snow removal and de-icing on public highways, is:

  • 25 250 kg for 10-wheel vehicles;
  • 32 000 kg for 12-wheel vehicles equipped with a front tandem axle (class A.3);
  • 31 000 kg for 12-wheel vehicles equipped with a front multiple axle (class A.3);
  • 31 000 kg for 12-wheel vehicles equipped with a front tandem axle (class A.4); and
  • 30 000 kg for 12-wheel vehicles equipped with a front multiple axle (class A.4).

As for vehicles assigned to snow removal and de-icing on public highways, the limit of 7250 kg on the front axle, used to establish the total loaded mass, will be replaced by a maximum load on the front axle in order to take into account the special snow removal equipment at the front of the vehicle, which, in most cases, slides on the pavement. The maximum total loaded mass is established by adding the maximum loads of each of the axle categories, without exceeding 19 000 kg for that type of 6-wheel vehicle and 27 000 kg for that type of 10-wheel vehicle.

With regard to the exemption from control of the load per axle, which was to end on December 31, 2001 in the case of certain vehicles of model years prior to 1992 that did not undergo any changes after October 1, 1991 to increase the axle capacity, the exemption will be extended until December 31, 2004. That exemption applies to single unit road vehicles equipped with a non-detachable dumping mechanism carrying sand, earth, gravel, stone, sodium chloride, snow, ice, hot mix asphalt or roller compacted concrete, as well as back loading refuse-compacting trucks and single unit road vehicles assigned to maintenance of public highways. These vehicles of model years prior to 1992 will not be subject to the control of the load per axle before January 1, 2005. (Text of the regulation)

Regulation respecting forest transport contracts

The purpose of the Regulation is to prescribe the stipulations applicable to any contract for the transport of timber that has undergone no operation other than cross-cutting, limbing and barking (logs, long-length timber) from forests in the domain of the State.

The stipulations of the forest transport contract are those appearing in the model referred to in Schedule A of the Regulation respecting forest transport contracts and they constitute the minimum stipulations that any forest transport contract must contain. The forest transport contract must be drawn up by completing a form similar to the model appearing in Schedule A of the Regulation and must be signed by the shipper and the carrier. Bulk trucking rate compendiums

Major changes to the bulk trucking rate compendiums

In accordance with the provisions of the Act respecting the Ministère des Transports, the Minister of Transport of Québec may determine the rates applicable to bulk trucking in certain contracts awarded by the MTQ. Thus, since the repeal of the Regulation respecting bulk trucking on January 1, 2000, the Ministère des Transports du Québec publishes three rate compendiums for its bulk trucking needs.

Within the context of renewal of the bulk trucking rate compendiums for 2006, here are the main changes:

Monetary changes
  • General rate increase of 6,62% applicable both to the hourly rate and to the rate per tonnekilometre.
Changes to the conditions of application
  • Change in the definition of hot-mix asphalt in relation with cement concrete haulage.
Fuel price compensation pilot project

Following the substantial increase in the price of fuel during the 2005 works season, the Ministère des Transports du Québec is setting up a pilot project to allow the establishment of a temporary adjustment formula for bulk trucking rates.

Thus, for the months of August to December 2005, the MTQ will publish at the beginning of each month, if applicable, a percentage surcharge applicable to the bulk trucking rate already published by the MTQ.

The posted percentage shall be added to the rates published on March 29, 2005. The percentage applies both to transportation paid by the hour and paid per tonne-kilometre.

For the purposes of the program, fuel is considered to be equivalent to 20% of a truck’s operating expenditures. The surcharge is determined according to the average price of fuel for the previous month.
