Export of U.S. Origin Goods and Technology Controlled
in the ECL (except ECL Item 5400)
The export from Canada of items of US origin which are controlled in
ECL Groups 2, 6, or in Item 5504 may require an explicit re-export authorization
issued by the US Government, which must be presented with the export permit
application. Please refer to the Export
Permits Regulations for more information.
Canadian exporters should be aware that US Government imposes other
re-export requirements on certain goods. As a condition of supplying items
to a Canadian company, the US may require the Canadian company to obtain
explicit re-export approval before exporting the items from Canada to
a third destination.
Canadian exporters should consult the original US supplier or the US
Government for more information.
Export of Goods and Technology of US Origin Controlled
by ECL Item 5400
The export from Canada of all items of US origin which have not been
“further processed or manufactured outside the US so as to result
in a substantial change in value, form, or use of the goods or in the
production of new goods” and which are not controlled elsewhere
in the ECL are controlled by Item 5400 and require an export permit.
Two types of export permit are possible in this case, depending on the
destination of the items:

Export of 5400 items to Iran, Cuba, Syria, North Korea, or to any
destination on Canada’s Area Control List requires an individual
export permit issued by the Export Controls Division.

For all other destinations, General
Export Permit No. 12 applies (see General Export Permits for more
information).
