Democratic Republic of the Congo

On July 28, 2003, the United Nations Security Council (UNSC) adopted Resolution 1493 and, acting pursuant to Chapter VII of the Charter of the United Nations, decided that all States shall prevent the supply of arms and technical assistance related to military activities to all foreign and Congolese armed groups and militias operating in the territory of North and South Kivu and of Ituri, in the Democratic Republic of the Congo (DRC), and to groups not party to the Global and All-inclusive Agreement, which aimed at consolidating the peace process and led to a transitional government in the DRC. The Governor in Council made the United Nations Democratic Republic of the Congo Regulations on October 19, 2004, in order to implement Canada's international obligations as set out in this resolution.

On April 18, 2005, the UNSC, acting again under Chapter VII of the Charter of the United Nations, adopted Resolution 1596, by which it then decided that the embargo on arms and technical assistance established by Resolution 1493 shall from now on apply to any recipient in the DRC, and that non-lethal military equipment intended for humanitarian and protective use and for the provision of supplies to the United Nations Organization Mission in the DRC (MONUC) shall be exempt. In the same Resolution, the UNSC also decided that all States shall impose a freeze of assets and a travel ban against those who are designated by a committee of the Security Council as acting in violation of the arms embargo originally imposed against the DRC by the Security Council under Resolution 1493. The Regulations Amending the United Nations Democratic Republic of the Congo Regulations came into force on 4 October 2005 and give effect to UNSC decisions found in Resolution 1596 regarding specific exemptions to the embargo on arms and technical assistance and the assets freeze. Implementation of the travel ban is ensured in Canada under existing provisions of the Immigration and Refugee Protection Act.
