Senior’s Life HD will devote
not more than 25% of the total programming broadcast during the
broadcast week to programs drawn from any one genre. |
|
Senior’s Life HD will devote
not more than 20% of the total programming broadcast during the
broadcast week to programs drawn from category 7. No programming drawn
from categories 7(b), 7(e) and 7(g) shall originate in the United
States. All programming from category 7, with the exception of
categories 7(b), 7(e) and 7(g), shall have been copyrighted 25 years
prior to the broadcast year in which it is aired by Senior’s Life HD. |

Senior’s Life HD will devote
not more than 25% of the total programming broadcast during the
broadcast week to programs drawn from category 8(a). Musical selections
used in programming drawn from category 8 will be from content
categories of particular interest to people 50 years of age and older
(for example, "rock and roll" and other genres popular from and prior to
the early 1980’s). |

identify in its application, whether it would be considered directly
competitive with existing Category 1 and analog pay and specialty
services, the applicant indicated that, with the exception of WTSN
(Women’s Sports Network), there are no existing Category 1 services or
analog pay or specialty services that could be considered similar to
Women’s Sports HD. |

The applicant added that The
Sports Network Inc. permanently ceased its operation of WTSN in
September 2003. Therefore, the mere technicality that The Sports Network
Inc. may not have surrendered its licence for WTSN should not act as a
barrier or restriction to others including the applicant. |

The steps of the reorganization

2. the acquisition by 1188011 Alberta
Ltd., a wholly owned corporation of Touch Canada, of the assets of
CJSI-FM and CJRY-FM from Touch Canada; and

3. the acquisition by Touch Canada Broadcasting (2006) Inc. (the
general partner), and 1188011 Alberta Ltd. (the limited partner),
carrying business as Touch Canada Broadcasting Limited Partnership
(collectively Touch Canada LP), of the assets of CJCA, and of
CJRY-FM and
CJSI-FM, from Touch Canada and 1188011 Alberta Ltd., respectively.

Following this corporate
reorganization, the ultimate control of the broadcasting undertakings
will continue to be exercised by Mr. Allard. |
|
The applicant is also
requesting new licences to be issued to Touch Canada LP to continue the
operation of the above undertakings under the same terms and conditions
as those of the current licences. |
|
In the event of a favourable
decision by the Commission of the application by Touch Canada for a new
FM in Fort McMurray, the applicant is further requesting that this new
FM forms part of this corporate reorganization and, if approved, is
requesting a new licence for that undertaking to be issued to Touch

former licensee) to amend the broadcasting licence for the radio
programming undertaking consisting of the transmitters CKGF Grand Forks,
CKGF-1-FM Christina Lake, CKGF-2-FM Greenwood and CKGF-3-FM Rock Creek,
in order to delete CKGF Grand Forks and to recognize that programming
now originates from CKGF-2-FM Greenwood. |

In order to change the class of
licence for CKGF-2-FM Greenwood to reflect that it is now an FM radio
programming undertaking, Vista has submitted this application for a new
FM service in Greenwood to effectively replace the non-existing CKGF
undertaking and to add the rebroadcasting facilities at Rock Creek and
Christina Lake. |

The new station would operate
on frequency 96.7 MHz (channel 244A)
with an effective radiated power of 40 watts (non-directional antenna/antenna
height of 574.5 metres). |

The rebroadcasting transmitter
at Christina Lake would operate on frequency 93.3 MHz (channel 227A1)
with an effective radiated power of 88 watts
