Registration as a Competitive Local Exchange Carrier (CLEC)

What is a CLEC?

A Competitive Local Exchange Carrier (CLEC) is a company that offers a local residential or business service in competition with the telephone companies that provided service prior to the introduction of competition in local service. In Local Competition, Telecom Decision CRTC 97-8, 1 May 1997 (Decision 97-8), the Commission required all CLECs wishing to enter the market to file specified information with the Commission. CLECs are identified with file number CRTC 8180-C12-08/00.

How to register as a CLEC

As required under the Entry Procedures in Decision 97-8 and the Canadian Telecommunications Common Carrier Ownership and Control Regulations:

  1. the CLEC must attest in writing that it understands and will conform to the obligations set out in Telecom Decision 97-8, and that it is Canadian owned and controlled within the meaning of section 16 of the Canadian Telecommunications Common Carrier Ownership and Control Regulations;
  2. the CLEC must provide a map of its proposed serving area to the Commission;
  3. the application filed with the Commission shall be served on all other Canadian carriers providing service in exchanges where the CLEC is proposing to provide service, and all other persons or companies who have proposed to provide service in compliance with these entry procedures;
  4. the CLEC shall file its proposed interconnection agreements and tariffs for Commission approval; and
  5. the CLEC must provide the Commission with all of the customer information identified in Part XIV (starting at paragraph 291), of Decision 97-81.

Please send the documentation referred to above to the Commission, addressed as follows: Diane Rhéaume, Secretary General, Canadian Radio-television and Telecommunications Commission, Ottawa, Ontario K1A 0N2, or electronically by using our electronic form.

Include the company’s name, address, the name and title of a contact person and that person’s telephone and fax numbers, and e-mail address in the cover letter.

How do I file a tariff with the CRTC?

Please refer to our web site at www.crtc.gc.ca under CISC for the Competitive Local Exchange Carrier Model Tariff and the User’s Guide for the CLEC Model Tariff.

How will I know I have been registered with the CRTC?

The Monday or Thursday following the receipt of your request to register, you should be able to view your name on our Proposed CLEC list posted on our web site at www.crtc.gc.ca under Industries at a Glance.

After Commission staff has processed your request to register, you will receive a letter from the Commission stating that you have met the Commission’s current CLEC requirements, and may go ahead to make any further arrangements necessary to allow you to provide local switched services.

Contribution

In Changes to the contribution regime, Telecom Decision CRTC 2000-745, 30 November 2000, the Commission concluded that all telecommunications service providers, such as incumbent local exchange carriers (ILECs), alternate providers of long distance services (APLDS), competitive local exchange carriers (CLECs), resellers, wireless service providers (WSPs), international licensees, satellite service providers, Internet service providers (if a telecommunications service is provided), payphone providers, data and private line service providers were required to contribute to a national contribution fund to subsidize local residential telephone service in rural and remote areas. Their contributions are based upon their total Canadian Telecommunications Service Revenues (CTSR), less certain deductions. CTSR are revenues from Canadian telecommunications services.

What if I need to make any changes to my registration information?

The registration information is to be kept current at all times. You must notify the Commission of any changes to the registration information including a change to the company’s name, address, the name and title of a contact person and that person’s telephone and fax numbers, and e-mail address in the cover letter.

1 local calling area boundaries;  details of all service options, with applicable prices; details of all potentially applicable service charges;  policy on access to enhanced service providers;  available special needs services;  information respecting privacy, including the company’s responsibilities with regard to protecting the confidentiality of customer records;  billing frequency and payment policy;  disconnection policy;  security deposit policy;  policy on directories;  the name and address of the company providing service to the customer;  a toll-free telephone number from which the customer can obtain further information or lodge a complaint;  billing date;  due date for payment;  interest rate applicable to late payments;  the information contained in section 3 of Part XIV of Decision 97-8 with respect to access to 9-1-1 service and MRS, including customer charges, if any;  and the information contained in section 4 of Part XIV of Decision 97-8 with respect to safety and privacy protection.
