Centrex service

The Commission received an application by
Société en commandite Télébec (Télébec), dated 25 October 2004, to
revise General Tariff item 2.8.4, Télébec Centrex Service, to allow
customers subscribing to its three- and five-year Centrex service
contracts for packages A, B, and C to extend their contracts by two
years. |

Télébec noted that its Centrex service is
part of the Uncapped Services basket. |

The Commission received no comments with
respect to the application. |

In Follow-up to Implementation of price
regulation for Télébec and TELUS Québec, Telecom Decision CRTC 2002-43
– Service basket assignment, Telecom Decision CRTC 2003-56,
22 August 2003, as amended by Telecom Decision CRTC 2003-56-1,
dated 8 April 2004 (Decision 2003-56), the Commission finalized the
assignment of tariffed services to the baskets of services established
in Implementation of price regulation for Télébec and TELUS Québec,
Telecom Decision CRTC 2002-43,
31 July 2002. As part of Decision 2003-56,
the Commission assigned Télébec's Centrex service to the Uncapped
Services basket, which is not subject to any upward pricing constraints. |

The Commission notes that subsection 27(2)
of the Telecommunications Act (the Act), states that: |

No Canadian carrier shall, in relation to the provision of a
telecommunications service or the charging of a rate for it, unjustly
discriminate or give an undue or unreasonable preference toward any
person, including itself, or subject any person to an undue or
unreasonable disadvantage.

The Commission notes that Télébec's
proposal would result in certain customers being charged lower rates
than other customers for the same service over the same service period.
The Commission considers that Télébec's proposal would give preferential
rate treatment to customers that extend existing contracts, constituting
unjust discrimination, contrary to subsection 27(2) of the Act. |

In light of the above, the Commission
denies Télébec's application. |
