PREAMBLE |
|
This Broadcasting Notice of
Public Hearing consists of four separate parts. |
|
Part 1 : Items 1 to 12 |
|
In the first part, the
Commission has listed licence applications (items 1 to 12) to operate
radio undertakings in the Québec market. |
|
As part of these items, the
Commission will consider three applications it considers competitive for
the Québec market. They include applications by 6087329 Canada inc.
(Patrice Demers) to renew the licence of commercial radio programming
undertaking CKNU-FM Donnacona and amend a condition of licence regarding
commercial messages, and to amend the technical parameters of CKNU-FM
Donnacona (item 11). The third application, by Radio Charlesbourg/Haute
St-Charles
(item 12), is to amend the technical parameters of French-language Type
B community FM radio station CIMI-FM Québec (zone Charlesbourg). |

The Commission notes that the
amendment to the CKNU-FM condition of licence proposed in the
undertaking’s renewal application and the proposed technical amendments
by radio station CKNU-FM and CIMI-FM, could result in these station
being considered stations that serve the Québec market. |

Part 2 : Items 13 and 14 |
|
In the second part of this
notice, the Commission has included the application by 6087329 Canada
inc. (Patrice Demers) for a licence to operate a French-language radio
network to broadcast public affairs programming, with phone-in shows,
hosted by André Arthur (item 13) and the application by Radio CHNC ltée
to renew the licence of commercial radio programming undertaking CHNC
New Carlisle (item 14). |

Part 3 : Items 15 to 22 |
|
In part three, the Commission
has listed applications concerning the Montréal market. Items 15, 16 and
17 are technically mutually exclusive as they propose the use of the
frequencies 106.5 MHz (for item 15) and 106.3 MHz (for items 16 and 17).
For Montréal, these will be treated as competitive radio applications. |
|
The Commission intends to
consider, subject to interventions, all applications for the Montréal
market (items 15 to 22) during the non-appearance phase of the public
hearing. |
|
Part 4 : Items 23 to 32 |
|
The fourth part of this Notice
includes the other applications (items 23 to 32) that the Commission
intends to consider, subject to interventions, during the non-appearance
phase of the public hearing. |

PART 1 :
The Québec Market |
|
Preamble |
|
On 13 July 2004, the Commission
issued Broadcasting Public Notice CRTC 2004-49,
calling for applications for broadcasting licences to carry on a French-language
radio programming undertaking to serve Québec, Quebec. Interested
parties had until 11 October 2004 to submit applications to the
Commission. |
|
On 26 August 2004, the Federal
Court of Appeal issued an Order to the Commission to stay the call
for applications for a broadcasting licence in Québec, as it relates
to applications proposing the use of the frequency 98.1 MHz. The stay
is in effect until the Court’s final judgment on the merits in the
matter of the appeal filed by Genex Communications inc. (Genex) from
Broadcasting Decision CRTC 2004-271
of 13 July 2004, denying the application by Genex to renew the licence
issued for station CHOI-FM, Québec, Quebec. Consequently, in Broadcasting
Public Notice CRTC 2004-49-1
of 14 September 2004, the Commission published an amendment
to the call for applications in order to specify that following an
Order from the Federal Court of Appeal, the call for application would
relate only to radio applications that proposed to use frequencies
other than 98.1 MHz. |
|
On 12 January 2005, the Commission
issued a second amendment to its call for applications to serve Québec,
Quebec. In Broadcasting Public Notice CRTC 2004-49-2,
the Commission pointed out that, it did not usually specify the language
of the service to be proposed in its calls for applications and should
not have done so in this case. Therefore, Broadcasting Public Notice
CRTC 2004-49 was being
corrected to exclude the reference to the language of the service
to be proposed. Interested parties were given until 28 February
2005 to submit applications to the Commission. Applicants that had
submitted applications in response to the original call CRTC 2004-49,
also had until 28 February 2005 to review and update their application. |
|
Further to this call for
applications, the Commission has received a number of applications for
licences to serve the Québec market. |
|
Items 1, 2 and 3 are
technically mutually exclusive as they propose the use of the
frequencies 92.5 MHz (for item 1) and 92.7 MHz (for items 2 and
3). |
|
Items 4 and 5 are technically
mutually exclusive as they both propose the use of the frequency 105.7
MHz. |
|
Items 6, 7 and 12 are
technically mutually exclusive as they propose the use of the frequency
106.9 MHz. |

its transmitter CKNU-FM-1 Sainte-Croix-de-Lotbinière, expiring 30
April 2006. |
|
The applicant is also
requesting the deletion of the condition of licence which states that it
must not solicit advertising from outside the Portneuf area. As a
result, the station could be considered one that would serve the Québec
market. |
|
In its application 2004-1220-6,
the licensee proposes to change the authorized contours by decreasing
the effective radiated power from 3,100 watts to 1,585 watts, by
increasing the antenna height and by relocating the transmitter from a
site at Saint-Raymond to the summit of Mont Bélair (non-directional
antenna/antenna height of 429 meters). |

The Commission notes that, as a
result of the proposed changes to the technical parameters, the
authorized contours would be displaced considerably and would encompass
the city of Québec. The station could be considered a station serving
the Québec market, including Donnacona. |
|
The Commission notes that in
Broadcasting CRTC Decision 2004-271
in which an application for renewal of licence by CHOI- FM was
denied, the Commission considered a broadcast that aired on both CHOI-FM
and CKNU-FM and that formed the subject matter of a complaint by the
Université Laval. The Commission found that the particular broadcast
breached the provisions of section 3(b) of the Radio Regulations,
1986 which prohibits the broadcast of abusive comments. |
|
The Commission further notes
that it has received a number of complaints with respect to the verbal
content of certain programs broadcast on CKNU-FM, including the one
noted above and those related to in Broadcasting Decisions CRTC 2004-316
and 2005-229. The
Commission intends to discuss all of these complaints at the public
hearing. The discussion will relate to the licensee’s spoken word
programming, in light of section 3(b) of the Radio Regulations,
1986 and of the objectives set out in section 3(1) of the Broadcasting
Act. |
|
The Commission will wish to
discuss the measures that the licensee has taken or may wish to take in
response to the concerns raised by the complaints, and such regulatory
measures as the Commission may consider appropriate, including possible
conditions of licence and the issuance of a mandatory order requiring
the licensee to comply with the Radio Regulations, 1986. |

watts, by increasing the antenna height and by relocating the
transmitter by approximately 5 km to Mont Reine-Malouin in Charlesbourg

station will be increased significantly resulting from the proposed
increase in power, increase in transmitter height and relocation of the
transmitter. |

As a result of the proposed
changes to the technical parameters, the authorized contours would
encompass the city of Québec. The station could be considered a station
serving the Québec market, including Charlesbourg. |

The Commission notes that it
has received a number of complaints regarding the verbal content of
certain programs hosted by André Arthur and broadcast on CIMI-FM radio
