Application for relief from section 25(a) of the Broadcasting
Distribution Regulations

The Commission received an application by
Vidéotron ltée, on behalf of itself and its subsidiary Videotron
(Regional) Ltd. (collectively, Vidéotron), to amend the broadcasting
licences for the cable distribution undertakings serving Québec,
Saint-Joachim and Sainte-Pétronille, Quebec. Specifically, Vidéotron
applied to be relieved of the requirement of section 25(a) of the
Broadcasting Distribution Regulations (the Regulations) that it not
distribute the community channel on a restricted channel. |

In New low-power community television
station in Québec, Broadcasting Decision CRTC 2003-413,
22 August 2003 (Decision 2003-413),
the Commission authorized a new low-power community television station
in Québec (Télé-Mag inc.) on channel 9. As a result of this authorization,
channel nine, which is used by Vidéotron to distribute the community
channel in the communities mentioned above, has changed from an unrestricted
channel to a restricted channel. |

The Commission did not receive any
interventions in connection with this application. |

In support of its application, Vidéotron
submitted that it is preferable to use the only VHF frequency still
available on the basic band for the new television station approved
in Decision 2003-413 and to continue
to distribute its community channel on channel 9, given that it is
the channel used for community programming almost everywhere in Quebec.

Given that there have been no complaints
about the distribution of the community channel on a restricted channel,
and in light of the reasons presented by Vidéotron, the Commission is
satisfied that it is appropriate, in the present case, to allow
Vidéotron to continue the distribution of the community channel on a
restricted channel. |

Consequently, the Commission approves
the application by Vidéotron ltée, on behalf of itself and its
subsidiary Videotron (Regional) Ltd. (collectively, Vidéotron), to be
relieved, by condition of licence, of the requirement of section
25(a) of the Regulations that it not distribute the community channel on
a restricted channel, so long as the quality of the signal does not
deteriorate. If the Commission finds that the quality of the signal has
deteriorated to the extent that reception problems are evident,
Vidéotron must immediately take the necessary corrective measures to
provide an adequate signal. |
