The licensee proposes to expand its program offering by
incorporating an interactive component that provides digital
subscribers with on-demand access to related and supplemental
weather information. To accommodate this plan, the licensee proposes
to amend its condition of licence pertaining to the nature of
service by adding the following: |

"The service may include an interactive capability,
enabled by the digital set-top boxes of broadcasting distribution
undertakings carrying the service, whereby individual subscribers
to the service will have access to additional programming content
related to meteorological, atmospheric and marine
conditions."

The licensee also proposes to incorporate the following
categories to the condition of licence relating to the nature of
service: |

The licensee proposes to increase its maximum wholesale rate by
$0.02 per subscriber per month from $0.23 to $0.25 effective 1
January 2002, where the service is distributed as part of the basic
service. |

In addition, the licensee proposes to provide separate Eastern
and Western programming feeds for ‘prime-time’ morning hours, to
provide more focused and relevant regional information. |
|
The Commission will also examine a complaint with respect to
provision of service by The Weather Network to visually-impaired
subscribers. |

that permits it to distribute one regional feed other than its

In Decision CRTC 2000-41 dated 11 February 2000, the Commission
approved Cogéco’s application to carry on the above-mentioned
transitional DRU. The Commission’s approval was subject to the
condition that the facilities be in operation within 12 months of
the date of the decision, i.e., by 11 February 2001. As well, in the
event that the licensee was unable to commence operations before
that date, it was required to apply to the Commission in writing to
extend the deadline. |

Since the licensee did not apply for an extension before the
12-month period expired, it must apply to the Commission for a new
licence to carry on a transitional DRU in Montréal and Laval. |
|
In light of the above and since there are no changes to the
application filed in 1999, the licensee requests that the Commission
accept a copy of its 1999 application as its current request. |

2000, the Radio Regulations, 1986 were amended, and as a
result, a community station must now devote 35% or more of its
musical selections from content category 2 each broadcast week. |

why a mandatory order requiring the licensee to comply with the
current required levels of Canadian content of musical selections,
as set out in the Radio Regulations, 1986, should not be
issued. |
