Bayshore Broadcasting Corporation
Owen Sound, Ontario 2000-2156-9 

The Commission approves the application for a new English-language FM radio station in Owen Sound. The terms and conditions of licence are set out in the appendix to this decision.

Bayshore Broadcasting Corporation (Bayshore) is the licensee of CFOS and CIXK-FM Owen Sound, the only two local commercial radio stations in the Owen Sound market. The Commission notes that this application falls within the scope of the policy on the common ownership of radio stations established in Public Notice CRTC 1998-41 entitled Commercial Radio Policy, 1998. According to this policy, in markets with fewer than eight commercial stations operating in a given language, a single licensee may be permitted to own or control as many as three stations operating in that language, with a maximum of two stations in any one frequency band.

The service

The applicant indicated that the new station will offer a country music format complemented by news and information packages that will concentrate on local and regional stories. Bayshore will also produce two daily short-feature programs to promote activities and events occurring in the Owen Sound area.

At least 37% of the popular musical selections that the station airs each broadcast week will be Canadian selections. This exceeds the 35% minimum level set out in the Radio Regulations, 1986. A condition of licence in the appendix to the decision requires the licensee to adhere to this commitment.

The licensee will devote a minimum of $5,000 per year in direct contributions to Canadian talent development. This amount includes an annual contribution to third-parties associated with the development of Canadian talent as prescribed under the terms set out in the Canadian Association of Broadcasters’ Distribution Guidelines for Canadian Talent Development. As well, the licensee will bring Canadian country artists to the Owen Sound area for public performances and concerts in order to promote the popularity of Canadian country music among its listeners. A condition of licence related to the applicant’s financial commitment for Canadian talent development is set out in the appendix to this decision.

The Commission received 67 interventions in support of the application. However, CKNX Radio, the licensee of CKNX and CKNX-FM Wingham, raised concerns about Bayshore’s application. While not objecting to the establishment of a new Owen Sound station, CKNX Radio objected to the transmitter site that the applicant had chosen. It considered that a transmitter located at the proposed site would put a strong signal into parts of CKNX Radio’s market, which would, in turn, have a negative impact on the audience and revenues of its AM station. The Commission is satisfied with Bayshore’s reply to the concerns raised in the intervention by CKNX Radio.

Terms of the licence for the radio programming undertaking at Owen Sound

The Commission will only issue the licence, and it will only be effective at such time as:

• The licensee confirms in writing that it is ready to begin operation. This must take place within 12 months of today’s date. Any request for an extension to that deadline requires Commission approval and must be made in writing within that period.

• The Department of Industry, having advised that the application is conditionally technically acceptable, has determined that there is no unacceptable interference with NAV/COM services and indicated that it will issue a broadcasting certificate (section 22(1) of the Broadcasting Act).

The licence, when issued, will expire 31 August 2007.

The station will broadcast on the FM band, on the frequency 93.7 MHz, channel 229B, with an effective radiated power of 31,600 watts.

The Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources
(see Public Notice CRTC 1992-59).

Conditions of licence

The licence will be subject to the conditions specified in the licence to be issued, as also set out in Public Notice CRTC 1999-137. The licence will also be subject to the following conditions:

1. The licensee shall, in lieu of the requirements set out in subsection 2.2(8) of the Radio Regulations 1986 and subject to subsection 2.2(6) of those regulations, devote, in a broadcast week, 37% or more of its musical selections from content category 2 to Canadian selections broadcast in their entirety.

For purposes of this condition, the terms "broadcast week," "Canadian selection" "content category," and "musical selection," shall have the meaning set out in the Radio Regulations, 1986.

2. The licensee shall devote a minimum of $5,000 per year in direct expenditures for the development of Canadian talent. This amount, includes a contribution to third parties associated with Canadian talent development as set out in the Canadian Association of Broadcasters’ Distribution Guidelines for Canadian Talent Development.
