Re: Review of Contribution Collection Mechanism and Related Issues, Telus’ and SaskTel’s requests for delay to filing responses to supplemental interrogatories

On 28 April 2000, the date that responses to supplemental interrogatories pertaining to the PN 99-6 proceeding were to be filed, TELUS Communications Inc. and TELUS Communications (B.C.) Inc. (Telus) informed the Commission that it was unable to respond to several of those interrogatories.

In a letter dated 23 May 2000, Telus was directed to file responses to those interrogatories and SaskTel was directed to file responses to several interrogatories set out in the Appendix to that letter, by 30 June 2000, serving copies on interested parties.

In a letter dated 1 June 2000, Telus requested that the Commission grant a further extension for the filing of responses to those interrogatories, to 14 August 2000. This is a fifteen-week extension to the original filing date of 28 April 2000 for responses to supplemental interrogatories identified in paragraph 20 of Commission staff’s letter dated 4 February 2000.

SaskTel, in a letter addressed to the Commission dated 12 June 2000, stated that it is also unable to meet the 30 June 2000 filing date and supports the modified dates suggested by Telus.

5. Telus and SaskTel are directed to file responses to the interrogatories, set out in the Commission’s letter dated 23 May 2000, with the Commission, serving a copy on all parties to the proceeding, by 21 July 2000. Any responses to these interrogatories filed after this date will not be considered in the Commission’s review of the contribution collection mechanism as the issuance of a decision in this proceeding must not be further jeopardized by delays.

6. A process to address requests for disclosure that parties may make in respect of the responses to interrogatories filed by Telus and SaskTel as of 21 July 2000 is established as follows:

Requests by parties for public disclosure of information, for which confidentiality has been claimed, setting out the reasons for disclosure, must be filed with the Commission and served on the company in question, by 28 July 2000.

The company may file written responses to requests for public disclosure with the Commission, serving a copy on the party making the request, by 3 August 2000.

A determination with respect to requests for disclosure will be issued as soon as possible, with the intention that any information to be provided pursuant to that determination be filed with the Commission and served on all parties no later than 18 August 2000.

All parties may file additional comments, restricted to the material placed on the public record on 18 August 2000, serving copies on all parties, by 31 August 2000.

All parties may file replies to additional comments, serving copies on all parties who filed comments, by 8 September 2000.

7. Parties are reminded that where a document is to be filed or served by a specific date, the document must be received, not merely sent, by that date.
