Seeking public input on access to multi-dwelling units, in-building
wiring and riser space

|
The CRTC is seeking public
input to suggest a fair regulatory approach to provide telephone and
cable companies with access to multi-dwelling units. |
|
Current government policy
supports end-user choice among broadcasting and telecommunications
service providers in apartment buildings and office complexes. |
|
The public is invited to
comment on how the Commission may regulate possible fees, charges, or
other terms and conditions that could be introduced. |

Eastlink/Norigen Part VII
applications - Access to in-building wire, dated 5 June 2000, made a
number of determinations related to the ability of competitive local
exchange carriers (CLECs) to connect to in-building wiring controlled by
Bell Canada and Maritime Tel & Tel Limited. The letter decision
approved moving the demarcation point to the main terminal room in
certain circumstances and an interim rate of $1 per month per channel for
each in-building wire connection. The Commission also directed CLECs and
other incumbent local exchange carriers (ILECs) owning or controlling
in-building wiring in a multi-dwelling unit to show cause why the same
regime should not apply to them. |

The 5 June 2000 decision
reiterated the Commission's intention in Location of demarcation point
for inside wire in multi-dwelling units and associated issues,
Telecom Decision CRTC 99-10,
to initiate a proceeding to examine issues surrounding fees, terms and
conditions under which all local exchange carriers (LECs) may: |

a) connect to in-building wire controlled by building owners or owned
and controlled by other LECs; or
|
|
b) gain access to building riser space to install their own
in-building wire.

The Commission notes that similar
issues could arise for coaxial facilities currently utilized by competing
broadcasting distribution undertakings (BDUs). As a result, the
Commission will also consider these issues in respect of the facilities
employed by BDUs in the provision of their services. |

Comments invited on fees, charges and terms for access
|

The Commission invites comment on
the regulatory approach (including possible fees, charges or other terms
and conditions) that should be used to facilitate non-discriminatory
access and customer choice in multi-dwelling units. Proposals should be
consistent with previous Commission decisions, policies and the
broadcasting and telecommunications policy objectives set out in section
3 of the Broadcasting Act and section 7 of the Telecommunications
Act. |

In addition to other issues and
approaches that parties may identify, the Commission invites comment on
the following: |

a) Commission-specified terms and conditions, including payment of
fees, pursuant to section 24 of the Telecommunications Act or by
such other means as are available for:
|
|
i) access to the main terminal room;
|
|
ii) access to riser space to install in-building wire for the LEC's
or BDUs' own use;
|
|
iii) access to other areas of the building that a LEC or BDU may
require;
|
|
iv) connection to in-building wire controlled by the building owner;
and
|
|
v) connection to in-building wire controlled by the LEC or BDU.
|
|
b) Commission-specified terms, conditions and charges payable between
LECs where alternative access arrangements are required, other than
unbundled loops from the central office or direct connection of LEC or
BDU facilities to in-building wire (e.g., access at the first available
underground chamber outside a building).

|
c) As an alternative to specifying terms, conditions and fees payable
as in i) and ii) above, issuance by the Commission of guidelines on the
appropriate terms, conditions and types of costs eligible for recovery
that BDUs or LECs and building owners can use as the basis for
negotiating in-building wire, riser space and meter room space
agreements.

d) Issues outstanding from Decision 99-10 that the Commission stated
it consider in this proceeding such as unilaterally assigning between
LECs the in-building wire controlled by building owners or LECs.

6. |
Parties are invited to identify
the advantages, disadvantages and implications of the approaches noted
above, and of other approaches they may identify. |
7. |
Interested parties are invited to
comment on the scope and nature of the Commission's jurisdiction to set
the terms and conditions of access, as discussed above. |

8. |
Parties wishing to participate in
this proceeding must notify the Commission of their intention to do so by
writing to Secretary General, CRTC, Ottawa, Ontario, K1A 0N2, fax: (819)
953-0795, by 8 September 2000. Parties are to indicate in the
notice their email address, where available. If parties do not have
access to the Internet, they are to indicate in their notice whether they
wish to receive disk versions of hard copy filings. |

The Commission will issue, as soon
as possible after the registration date, a complete list of parties and
their mailing address (including their email address, if available),
identifying those parties who wish to receive disk versions. |

Parties may file submissions with
the Commission, serving copies on each other, by 25 September 2000. |
11. |
Parties may address
interrogatories to other parties, filing copies with the Commission, by 10
October 2000. Responses to the interrogatories are to be filed
with the Commission, with copies served on all parties by 23 October
2000. |
12. |
Requests by parties for further
responses to their interrogatories, specifying in each case why a further
response is both relevant and necessary, and requests for public
disclosure of information for which confidentiality has been claimed,
setting out in each case the reasons for disclosure, must be filed with
the Commission, and served on all interested parties by 30 October
2000. |
13. |
Written responses to requests for
further responses to interrogatories and for public disclosure must be
filed with the Commission and served on the party making the request by 6
November 2000. |
14. |
Requests for disclosure and for
further information will be dealt with as soon as possible, and it is
expected that any information to be provided pursuant to that disposition
be filed with the Commission and served on all parties to the proceeding
by 27 November 2000. |
15. |
All parties may file comments with
the Commission, serving copies on all other parties by 4 December 2000. |
16. |
All parties may file replies to
any comments made, serving copies on all parties who filed comments, by 13
December 2000. |
17. |
Where a document is to be filed or
served by a specific date, the document must be actually received, not
merely mailed, by that date. |

Parties wishing to file an
