PREAMBLE |
|
At the 26 May 2003 public hearing, the Commission will examine
applications to renew the licences of the 22 specialty television
services approved in September 1996. These applications are items 1
to 22 in Part A of the notice of public hearing. |
|
The Commission intends to consider the following issues, among
others, at the hearing and invites interested parties to comment on
any issue. |
|
Wholesale rates |
|
The Commission will examine any proposed increases in the monthly
wholesale rates charged to distributors, where the service is
carried as part of the basic service. The Commission will also
examine the criteria to be used in setting wholesale rates. |
|
Canadian programming and expenditure commitments |
|
The Commission will examine the appropriateness of increasing the
licensee’s contributions to Canadian programming, in terms of the
exhibition of Canadian content and/or expenditure commitments, where
existing commitments to Canadian programming and/or to Canadian
programming expenditures are low in relation to other specialty
services, or where the financial situation or nature of service
warrants it. |
|
Changes to nature of service definitions |
|
The Commission will examine proposals to amend nature of service
conditions of licence that would appear to represent a significant
shift, to ensure that such amendments are consistent with the
Commission’s one-per-genre policy and its objective of programming
diversity. |
|
Dealing with programs received across time zones |
|
In its Policy on violence in television programming,
Public Notice CRTC 1996-36, 14 March 1996, the Commission
encouraged programming undertakings whose signals are distributed
over various time zones to be sensitive to their viewers in western
time zones when scheduling programs. The Commission will examine the
mechanisms and policies licensees have in place to ensure that
programming intended for adult audiences respects the watershed
hours of 9 p.m. to 6 a.m. in all time zones. |
|
Service to persons who are visually impaired |
|
A number of licensees have indicated that there are technical
issues that currently constrain the ability of distributors to pass
through or otherwise make available described video programming that
specialty services provide in a closed format. The Commission will
wish to explore solutions to these delivery issues. The Commission
will also explore appropriate commitments to the broadcast of
described programming as well as alternatives for making television
programming more accessible to persons who are visually impaired. |
|
Closed captioning |
|
The Commission will examine each licensee’s commitment to
closed captioning to ensure that it is in keeping with the
Commission’s objectives, as well as the steps the licensee is
taking to ensure the quality, reliability and accuracy of its
captioning. |
|
Cultural diversity |
|
The Commission will examine the ways in which each licensee
contributes to a broadcasting system that accurately reflects the
presence in Canada of cultural and racial minorities and Aboriginal
peoples in keeping with the Commission’s objectives in this area. |
|
Independent and regional production and regional reflection |
|
The Commission will explore the licensees’ commitments to
independent production, as well as their contributions to regional
production and reflection.

Chatham, Ontario (e)
Application No. 2002-0366-2 |
|
Application by BEA-VER COMMUNI-CATIONS INC. to amend the
licence for CKUE-FM Chatham as follows: |
|
- by adding a transmitter at Windsor;
|
|
- by amending the condition of licence requiring a minimum
level of local programming from 42 hours to 84 hours;
|
|
- by amending the condition of licence to increase its Canadian
Talent Development commitment from the current $400 per year to an
additional $5,000 in 2004, $10,000 in 2005, and $15,000 in 2006;
|
|
- by broadcasting a maximum of 85% hits.
|
|
The new transmitter would operate on frequency 95.1 MHz (channel
236A) with an effective radiated power of 400 watts. |
|
This would be a synchronous repeater of CKUE-FM Chatham, using
the same frequency as the mother station. Bea-Ver would add a studio
in Windsor and, combined with programming originating in Chatham,
would henceforth produce a weekly minimum of 84 hours of programming
reflecting both Chatham/Kent and Windsor. It would also seek
advertising in Windsor. |
|
Approval would entail one common signal distributed by both
transmitters. |

Application No. 2002-0350-6 |
|
Application by CROSSROADS TELEVISION SYSTEM relating to
television station CITS-TV. |
|
The licensee proposes to amend its licence by adding transmitters
at Ottawa and London to rebroadcast the programming of
CITS-TV, Burlington. |
|
The Ottawa transmitter would operate on channel 14C with
an effective radiated power of 109,000 watts. |
|
This application is technically mutually exclusive with an
application by Rogers Broadcasting Limited to establish a
rebroadcasting transmitter for OMNI.2 in Ottawa. |
|
The London transmitter would operate on channel 14B with
an effective radiated power of 7,700 watts. |
|
The applicant indicates that it requires the increased coverage
to ensure survival of its service in its present form. In addition,
the applicant points to a significant demand for CITS-TV in both
Ottawa and London. |
|
Recognizing that an approval of this application would create an
additional priority signal in the affected markets, the Commission
will want to assess, in addition to the impact on other broadcasting
services, the impact of cable channel realignment, especially in the
National Capital Region where a balance of English- and
French-language services is an important objective. |
|
The Commission will only proceed with this application at the
public hearing if advised by the Department of Industry, at least
ten days prior to the hearing, that it is technically acceptable. |

Application No. 2002-0641-8 |

Application by ROGERS BROADCASTING LIMITED ("Rogers")
relating to television station OMNI.2, formerly CFMT
"too". |
|
Broadcasting Decision CRTC 2002-82 approved, in part, Rogers
application for OMNI.2, a new ethnic television station to serve the
ethnic communities in the Toronto/Hamilton area. OMNI.2 is a sister
station to OMNI.1, formerly CFMT-TV Toronto. OMNI.1 already has
rebroadcasting transmitters in Ottawa and London. |
|
The licensee proposes to amend its licence for OMNI.2 in order to
add two new rebroadcasting transmitters at Ottawa and London to
offer the programming of OMNI.2. |
|
The proposed Ottawa transmitter would operate on channel 14C with
an effective radiated power of 435,000 watts. This application is
technically mutually exclusive with an application by Crossroads
Television System to establish a rebroadcasting transmitter for CITS-TV
Toronto/Hamilton in Ottawa.. |
|
The proposed London transmitter would operate on channel 20B with
an effective radiated power of 18,800 watts. |
|
|
The September 2002 launch of OMNI.2 involved approximately 28
hours of programming in 11 different Asian and African languages
being moved to OMNI.2 from OMNI.1. The proposed rebroadcasting
transmitters would ensure that these programs would continue to be
available in London and Ottawa to audiences which have
traditionnally received them over-the-air. |
|
The Commission will only proceed with this application at the
public hearing if advised by the Department of Industry, at least
ten days prior to the hearing, that it is technically acceptable. |
