RE: Confirmation - Fulfillment of CLEC Requirements – Bell Canada's Serving Territory – Cogeco Cable Canada Inc.

This is in response to a letter from Cogeco Cable Canada Inc. ("CCC") dated 21 December 1999 in which it provided information regarding how it satisfied the requirements imposed on Competitive Local Exchange Carriers (CLECs) in Telecom Decision CRTC 97-8, Local Competition, 1 May 1997 (Decision 97-8).

Based on the statements made by CCC in its letter, Commission staff considers that CCC has met the CLEC requirements set out by the Commission in Decision 97-8. CCC can provide service as a CLEC, provided it continues to meet those requirements and complies on an ongoing basis with the Canadian ownership and control regime set out in section 16 of the Telecommunications Act and in the associated regulations.
