REPORT ON THE ADMINISTRATION OF THE
COLLECTIVE BARGAINING PROVISIONS
OF THE YUKON EDUCATION STAFF RELATIONS ACT FOR
THE FISCAL YEAR ENDING
MARCH 31, 2003

INTRODUCTION

The Education Act, S.Y. 1989-90, c 25, which created the Yukon Teachers Staff Relations Board, was repealed on April 23, 2002, by the coming into force of the new Education Staff Relations Act, S.Y. 2001, c. 14. On the same date, a new Yukon Teachers Staff Relations Board was created.

Yvon Tarte has been re-appointed as chairperson under the new legislation. M.-M. Galipeau, G. Gigučre, L.-P. Guindon, E. Henry, J.W. Potter and J.-P. Tessier have been re-appointed as Board members under the new legislation. I. Mackenzie and D. Quigley have been appointed as Board members. R.E. Bilson, Q.C., S. Kelleher, Q.C., S. Lanyon, Q.C., K.E. Norman and C. Taylor, Q.C. have been re-appointed as adjudicators under the new legislation. F. Chad Smith, Q.C., B. Foley and John B. Hall have also been appointed as adjudicators.

During the year under review, proceedings that came before the Board involved one reference to adjudication.

GRIEVANCES/ADJUDICATION

The Board dealt with one grievance concerning a termination of employment.

The case in question was filed in May 2002. The issue to be resolved arose from a series of events over an extended period of time. Since the matter involved a termination of employment, it was scheduled for October 16 and 17, 2002, in Whitehorse.

The Yukon Teachers' Association and the Government of the Yukon agreed that there would be some merits to having this case heard by Mr. C. Taylor as he had been involved in a previous adjudication connected with this grievance.

On October 12, 2002, the Board was informed by the Employer that the parties had reached a settlement in the above matter and that the hearing was no longer required.

On October 15, 2002, the proceedings were terminated and the file was closed (Board file 367-YG-13).
