REPORT ON THE ADMINISTRATION
OF THE YUKON EDUCATION
STAFF RELATIONS ACT

FOR THE FISCAL YEAR ENDING
MARCH 31, 2004

INTRODUCTION

          During the year under review, proceedings that came before the Board involved two references to adjudication dealing with policy grievances related to the staffing protocol. No reference to adjudication was carried over from the previous year.

B. Foley and S. Kelleher, Q.C., have resigned as adjudicators.

GRIEVANCES/ADJUDICATION

          The Board dealt with two grievances concerning policy grievances related to the staffing protocol.

The cases in question were filed in May 2003. The matter involved the failure to post an administrative position and the bargaining agent asked the Board to scheduled a hearing. The hearing was scheduled for February 12 and 13, 2004, in Whitehorse, Yukon.

On January 16, 2004, the Board informed the parties that no adjudicator was available to hear these cases in February 2004 and suggested alternate dates upon which the parties could consult and mutually agree.

On January 27, 2004, the Board was informed that the parties discussed the matter and determined that May 18 to 21, 2004, would be favourable dates.

These references to adjudication were carried over to the next fiscal year. (Board files 369-YG-4 and 5).
