Legislative Basis
- S. 48 (1) After completion of assessment - notification of person considered for each appointment
- (a) & (b) who to advise
- (2) waiting period
- (3) notification of person appointed or proposed for appointment
- S. 49 Decision is final
When is the Assessment Complete?
- When all merit criteria have been assessed for the specific appointment
- Notification is for each appointment
Notification
Who to notify?
- Advertised process - persons in area of selection who participated in the process
- Non-advertised - persons in area of selection
What to notify?
- 1st Notification - Name(s) of person(s) being considered
- 2nd Notification - Name of person(s) proposed or appointed, Right to go to PSST, grounds for complaint to PSST, manner and time period within which complaint may be made
How to notify?
- Must be in writing as per Commission policy

- 2-stage process based on legislation
- Flexibility to establish waiting period longer than 5 days
- Opportunity to resolve issues before recourse (no appointments or proposed appointments during waiting period)
Policy Highlights

Policy Requirements:
- Notification must be in writing for each appointment
- Minimum waiting period - 5 calendar days
- e.g. begins on June 16 and ends on June 21
- Must be notified of duration of waiting period
- Notification of Appointment or Proposed Appointment, must also advise of :
- Right and grounds to go to PSST
- Manner and timeframe to go to PSST
Communicating the Notification Publicly
Must be in both official languages, except where:
- the notification is to be made only in a region that is unilingual for language-of-work purposes and the work to be performed only requires the knowledge and use of the language of that region; and
- the extranet site for employees of the Government of Canada (Publiservice) is not used to provide the notification
Must be available in usable format to accommodate disabilities.

Scenario #1
Non-advertised process, asset qualifications identified for the positions.
The manager considers 5 persons for generic positions. Three meet the essential qualifications and the asset qualifications. There are 3 positions to fill: one immediately and two in six months.

Scenario #2
Advertised process - asset qualification and operational requirements identified - only 10 persons meet the essential qualifications. One position to fill immediately, for which the asset qualification and operational requirements are not applied. Other appointments expected to be made but the number of positions is unknown.
