Her Majesty, by and with the advice and
consent of the Senate and House of Commons of Canada, enacts as follows:

1. Section 7 of the Canadian
Human Rights Act is renumbered as subsection 7(1) and is amended by
adding the following:

(2) Notwithstanding subsection
(1), it is not a discriminatory practice for an employer to require that a
person who is applying for a position with that employer undergo testing to
determine whether any alcohol or drugs are present in the person’s blood if
the consumption of alcohol or drugs by a person in that position could have a
detrimental effect on safety in the workplace or on public safety.

(2) Ne constitue pas un acte discriminatoire au sens du paragraphe (1)
le fait pour l’employeur d’exiger que la personne qui pose sa candidature à
un poste subisse des analyses visant à déceler la présence d’alcool ou de drogues
dans le sang, dans les cas où la consommation d’alcool ou de drogues par le
titulaire du poste risquerait de compromettre la sécurité dans le lieu de
travail ou la sécurité publique.
