Licences
In the electricity sector, companies must be licensed in order
to generate, deliver or sell electricity. This includes generators,
transmitters, local distribution companies (also called “utilities”),
wholesalers and retailers. In natural gas, only marketers who sell
natural gas to low volume customers are required to have a licence
from the OEB.
The Board may impose penalties of up to $20,000 per day for a breach
of the OEB Act, 1998, and certain provisions of the Electricity
Act, 1998, or the Board's licences, rules or orders.
As of August 1, 2003, with the passage of the Ontario Energy
Board Consumer Protection and Governance Act, the Board's Management
Committee can delegate powers and duties to an employee of the Board.
The Board's Management Committee has delegated to a Board employee
the power and duty to determine licence applications. Any decisions
made by the employee can be appealed to the Board.
CODES OF CONDUCT
To ensure consumer protection in the energy markets, the Board
has developed codes of conduct for gas marketers
and electricity retailers.
