EXPIRY REVIEW DECISION

Preformed Fibreglass Pipe Insulation

On March 10, 2003, the Canadian International Trade Tribunal (Tribunal), pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its order, made on November 18, 1998, in Review No. RR-98-001, continuing without amendment, its finding made on November 19, 1993, in Inquiry No NQ-93-002, concerning preformed fibreglass pipe insulation with a vapour barrier, originating in or exported from the United States of America. As a result, the Commissioner of the Canada Customs and Revenue Agency (Commissioner) commenced an investigation on March 11, 2003, to determine whether the expiry of the order is likely to result in the continuation or resumption of dumping of the goods.

The investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of SIMA, the Commissioner has determined that the expiry of the order is likely to result in the continuation or resumption of dumping of the goods.

A Statement of Reasons that contains additional details concerning the determination made by the Commissioner will be issued within fifteen days. The Statement of Reasons will also be posted on the Canada Customs and Revenue Agency Web site at:

The Tribunal will now conduct an inquiry to determine whether the continued or resumed dumping is likely to result in injury or retardation to Canadian industry and will make an order by November 17, 2003.
