EXPIRY REVIEW DECISION

Certain flat hot-rolled carbon and alloy steel sheet and strip

On September 24, 2003, the Canadian International Trade Tribunal (Tribunal), pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its finding made on July 2, 1999, in inquiry No. NQ-98-004, concerning certain flat hot-rolled carbon and alloy steel sheet and strip originating in or exported from France, Romania, the Russian Federation, and the Slovak Republic. As a result, the Commissioner of the Canada Customs and Revenue Agency (CCRA) initiated an investigation on September 25, 2003, to determine whether the expiry of the finding is likely to result in the continuation or resumption of dumping of the goods.

On December 12, 2003, the responsibility for the customs program of the CCRA was transferred to the new Canada Border Services Agency (CBSA), created on the same date. All of the responsibilities of the former Commissioner of the CCRA with respect to administration of SIMA were transferred to the President of the CBSA on that date.

The investigation has now been completed and today, pursuant to paragraph 76.03(7)a) of SIMA, the President (CBSA) has determined that the expiry of the finding is likely to result in the continuation or resumption of dumping of the goods from Romania, the Russian Federation and the Slovak Republic and is unlikely to result in the continuation or resumption of dumping of the goods from France.

A Statement of Reasons that contains additional details concerning the determination made by the President will be issued within fifteen days. The Statement of Reasons will be posted at the following web site: www.ccra-adrc.gc.ca/customs/business/sima/.

The Tribunal will now conduct an inquiry to determine whether the continued or resumed dumping is likely to result in injury or retardation to Canadian industry, and will make an order by June 30, 2004
