EXPIRY REVIEW DECISION

Certain corrosion-resistant steel sheet products

On November 13, 2003, the Canadian International Trade Tribunal (Tribunal), pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its orders made on July 28, 1999, in Review No. RR-98-007, continuing, with amendment, its findings made on July 29, 1994, in Inquiry No NQ-93-007, concerning certain corrosion-resistant steel sheet products originating in or exported from Brazil, the Federal Republic of Germany, Japan, the Republic of Korea and the United States of America. As a result, the Commissioner of the Canada Customs and Revenue Agency (CCRA) initiated an investigation on November 14, 2003, to determine whether the expiry of the orders is likely to result in the continuation or resumption of dumping of the goods.

On December 12, 2003, the responsibility for the customs program of the CCRA was transferred to the new Canada Border Services Agency (CBSA), created on the same date. All of the responsibilities of the former Commissioner of the CCRA with respect to administration of SIMA were transferred to the President of the CBSA on that date.

The investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of SIMA, the President has determined that the expiry of the orders: (1) is likely to result in the continuation or resumption of dumping of the goods from Brazil, the Federal Republic of Germany, Japan and the Republic of Korea; and (2) is likely to result in the continuation or resumption of dumping of the goods from the United States of America.

A Statement of Reasons that contains additional details concerning the determination made by the President will be issued within fifteen days. The Statement of Reasons will be posted at the following web site: www.cbsa-asfc.gc.ca/sima/.

The Tribunal will now conduct an inquiry to determine whether the continued or resumed dumping is likely to result in injury or retardation to Canadian industry, and will make an order by July 27, 2004
