Importation of Human-use drugs

1. This Interim Memorandum outlines the policy and customs procedures related to the importation of human-use drugs, including traditional medicines, over-the-counter medications, prescription drugs, and those that are controlled, narcotic, or restricted. It does not contain information on drugs for veterinary use.

2. The Controlled Drugs and Substances Act, which came into force on May 14, 1997, replaces the Narcotic Control Act and Parts III and IV of the Food and Drugs Act. However, the existing Narcotic Control Regulations, as wellas Parts G and J of the Food and Drug Regulations dealing with the controlled and restricted drugs requirements, remain in force, under the authority of the Controlled Drugs and Substances Act.

3. This Interim Memorandum supplements Memorandum D19-9-1, Regulation of Food, Drugs and Radiation Emitting Devices (Food and Drugs Act and Radiation Emitting Devices Act), dated September 7, 1993, and Memorandum D19-9-2, Regulations of Narcotics and Controlled and Restricted Drugs (Narcotic Control Act, Food and Drugs Act), dated July 26, 1993. Importation of Human-use drugs

In accordance with the Food and Drugs Act, the distribution and sale in Canada of all drugs are regulated and controlled by Health Canada. The Controlled Drugs and Substances Act regulates the importation of substances or drugs classified as controlled, narcotic, or restricted. Revenue Canada assists Health Canada with the administration of the Food and Drugs Act and the Controlled Drugs and Substances Act. This Interim Memorandum outlines the policy and customs procedures related to the importation of human-use drugs.

GUIDELINES AND GENERAL INFORMATION

Definitions

1. In this Interim Memorandum, various terms are used that apply to the importation of drugs. Definitions for these terms are as follows:

"Drug," under the Food and Drugs Act, includes any substance or mixture of substances manufactured, sold, or represented for use in:

(a) the diagnosis, treatment, mitigation, or prevention of disease, disorder, or abnormal physical state, or symptoms in human beings or animals;

(b) restoring, correcting, or modifying organic functions in human beings or animals; and

(c) disinfection of premises in which food is manufactured, prepared, or kept.

"Drug Identification Number (DIN)/General Public (GP)" are eight-digit numbers located on the label of any drug product that has been approved for retail sale in Canada. They indicate that a product has undergone and passed a review of its formulation, labelling, and instructions for use.

"Personal Use" includes the importation for use by one person, either the importer or another individual member of the importer's immediate family. For the purpose of this clause, immediate family is defined as father, mother, children, or spouse (including common-law spouse) with whom the importer permanently resides.

This Interim Memorandum makes reference to importations of a three-month supply of drugs. A three-month supply is determined by reviewing the directions for use on the label of the product; for example, take one tablet three times a day. In the case of a drug to be taken on an "as needed" basis, customs inspectors should review the directions for use on the label and be guided accordingly. Health Canada advises that discretion may be required in applying the three-month criteria in unusual circumstances; for example, long-term visitors to isolated locations, long-term visitors where language or other barriers may impede establishing an association with a Canadian physician, persons returning from countries that dispense drugs in trade packages.

"Traditional medicine" refers to drugs that contain a plant, mineral or animal substance in respect of which therapeutic activity or disease prevention activity is claimed, including traditional herbal medicines, traditional Chinese medicines, ayurvedic (East Indian) medicines, and traditional aboriginal North American medicines, and of whichthe medical use is based solely on historical and ethnological evidence from references relating to a medical system other than the one based on conventional scientific standards.

"Homeopathic preparations" refer to preparations used in a system of medical practice that treat disease by the administration of minute doses of a remedy that would, in healthy persons, produce symptoms of the disease treated.

"Products subject to special measures" refer to traditional medicines, homeopathic preparations, and vitamin and mineral supplements for human use, when in dosage form for which prescriptions are not required.

2. Revenue Canada assists Health Canada in controlling the importation of drugs into Canada. These drugs include, but are not limited to, prescription drugs, narcotics, controlled and restricted drugs, products that can be purchased over-the-counter without a prescription, drugs unapproved for sale in Canada, and products subject to special measures. Section 23 of the Food and Drugs Act authorizes the seizure and detention of any drug product that is being imported in contravention of the Food and Drugs Act. Section 31 of the Controlled Drugs and Substances Act authorizes the seizure and detention of any drug or substance that is being imported in contravention of the Controlled Drugs and Substances Act.

3. Appendix A contains a quick reference guide outlining requirements for personal and commercial importations of human-use drugs.

Drug Identification Number (DIN)/General Public (GP)

4. A DIN/GP is displayed on the label of any drug product that has been approved for retail sale in Canada. Any drug products in shipments examined by Revenue Canada that lack evidence of DIN/GP compliance are to be detained and referred to Health Canada. Health Canada may also identify specific shipments or products that are to be detained by Revenue Canada and referred to Health Canada. Health Canada will subsequently advise customs if the shipment may be released or of other action to be taken.

Prescription Drugs

5. The Food and Drug Regulations restrict the importation of prescription drugs listed in Schedule F, Part I, or Schedule F, Part II, that are not for veterinary use. Importation is restricted to a practitioner, a drug manufacturer, a wholesale druggist, a registered pharmacist, or a resident of a foreign country while a visitor in Canada. Individuals, including Canadian residents, arriving in Canada from abroad are usually permitted to import a single-treatment size or a three-month supply of a Schedule F drug for their personal use. The drug must be packaged in pharmacy or hospital dispensed packaging. Any other importations of prescription drugs will be detained by Revenue Canada and referred to Health Canada.

6. A listing of drugs contained in Schedule F, Parts I and II, of the Food and Drug Regulations is attached at Appendix B.

Controlled Drugs and Substances

7. Under the Controlled Drugs and Substances Act, narcotics and controlled and restricted drugs may be imported only by dealers licensed by Health Canada. The dealer must have a valid permit issued by the Health Canada Bureau of Drug Surveillance for each shipment and the permit must be presented to customs at the time of release. Individuals can obtain controlled drugs not available in Canada through their doctor who can use the emergency drug release provisions of the Food and Drugs Act. Special permit procedures involving the Health Canada Bureau of Drug Surveillance need to be followed.

8. The original import permit issued by Health Canada must be presented by the licensed dealer or their agent in order to obtain release of a shipment of controlled drugs or substances. Customs inspectors will validate and date-stamp the permit, and forward it to Health Canada at the following address:

Traditional Medicines, Including Herbal Products

10. Traditional medicines generally do not have a DIN/GP if they do not make any therapeutic claims. Currently, they are generally controlled as food products. Revenue Canada will refer to Health Canada commercial shipments of traditional medicines that make therapeutic claims. Health Canada will determine whether or not the goods may be imported. Personal importations of traditional medicines are permitted in a single-treatment size or a three-month supply.

Homeopathic Preparations, Vitamin and Mineral Supplements

11. Homeopathic preparations must be labelled as such to be considered as homeopathic preparations. Homeopathic preparations, or vitamin or mineral supplements, are considered to be offered for sale to treat or prevent diseases or symptoms regardless of claims, are regulated as drugs under the Food and Drugs Act, and require a DIN. Any such products in commercial shipments examined by Revenue Canada that lack evidence of DIN/GP compliance are to be detained and referred to Health Canada. Health Canada may also identify specific shipments or products that are to be detained by Revenue Canada and referred to Health Canada. Health Canada will subsequently advise customs if the shipment may be released or of other action to be taken. Personal importations of these products are permitted in a single-treatment size or a three-month supply.

Special Access Program (SAP) for Drugs Not Available in Canada

12. In cases where a required drug is not available in Canada, physicians, dentists, and veterinarians may seek authorization from Health Canada to import the drug through the emergency drug release provisions of the Food and Drug Regulations. If authorization is granted, Health Canada will provide a Letter of Authorization to the practitioner. This letter will usually accompany the shipment and must be presented to customs to obtain release of the drug.

Disposal

13. Where Health Canada advises Revenue Canada that goods detained on their behalf are to be disposed of, Health Canada will assist customs in making disposal arrangements and will assume responsibility for the costs incurred for the disposal after the goods become forfeit to the Crown. However, before any expenses are incurred, the appropriate regional director of the Health Protection Branch must be advised in order to consider alternatives.

14. Health Canada will not be responsible for the wages of customs officers involved in arranging or supervising the disposal of goods.
