AMENDMENT TO THE REGULATION UNDER THE PENSION BENEFITS ACT OF MANITOBA

An amendment has been made to Section 8 of Regulation 188/87 R under The Pension Benefits Act of Manitoba.

The amendment to Section 8 reads as follows:

Registration fees

8 Upon application for registration of a pension plan pursuant to subsections 18(l) and 18(2) of the Act, or upon the filing of an annual information return pursuant to subsection 18(4) of the Act, a fee of $6.00 shall be paid in respect of each member of the pension plan in Manitoba and in respect of each member of the pension plan in a designated province, reported to be on the payroll of the employer; but the total fee payable shall be not less than $100.00 and not more than $15,000.

Effective January 1, 2002, the registration fees for applications for registration and annual pension plan information returns of plans with 2,500 members or more are subject to a maximum filing fee of $15,000. Plans with fewer than 2,500 members are subject to the fee of either $6.00 per member or the $100.00 minimum, as applicable.

Any registration or annual information return filed with the Pension Commission after January 1, 2002 will be subject to the new fee. Incorrect fees will either be returned and plan sponsors asked to file the correct amount, or additional amounts may be requested.
