The Investment Canada Act reviews significant business investments in Canada by non-Canadians. If you are not a Canadian citizen or not considered a permanent resident under the Immigration Act, you are a non-Canadian and must fulfil the requirements of the Investment Canada Act before doing business in Canada.
Under the Act, a non-Canadian includes also any business entity that is not controlled or beneficially owned by Canadian citizens. This means if you are a non-Canadian and you plan to acquire control over an existing Canadian business or establish a new business in Canada, you must contact the Canadian government to file either a Notification or an Application for Review.
