History

In December 2004, the Hon. Joseph Frank Fontana, Minister of Labour and Housing, announced a Review of Part III of the Canada Labour Code (Labour Standards). This is the first comprehensive review of federal labour standards since this legislation was enacted in 1965.

The Minister has appointed Professor Harry W. Arthurs as Commissioner to head this Review. The Commissioner will be supported by an advisory panel including Ms. Sherry Liang, Professor Daphne Taras and Professor Gilles Trudeau. Representatives from key business and labour organizations will also play an advisory role.

The purpose of the Review is to produce recommendations for legislative changes to modernize federal labour standards and ensure that they remain relevant and effective in the 21st century. As part of his mandate, the Commissioner can also make recommendations of a non-legislative nature for consideration by government as well as business and labour organizations.

Among other issues, the Review will look at the changing nature of work, new forms of employment relationships, measures to improve work-life balance, demographic changes in the workplace and the need for effective enforcement of Part III of the Canada Labour Code.

Public hearings were held in September and October 2005. These provided interested individuals and organizations an opportunity to express their views on how the workplace has evolved and on the diverse needs of federally regulated businesses and workers. Those who wished to send written submissions and comments on issues falling within the mandate of the Review could do so before October 31, 2005.
