Message From The Chief Commissioner

Welcome to the Indian Claims Commission web site! Whether you're a student, an academic, a journalist, a First Nation member - or just plain curious - we hope you'll find something of interest about specific land claims on this site.

The Indian Claims Commission was established in 1991 as a Commission of Inquiry mandated to help First Nations and the federal government settle claims. Located in Ottawa, the Commission has a staff of approximately 51 people and a budget of $6.9 million (fiscal year 2005-2006). The Commission's day-to-day operations are carried out by a Management Committee which reports to the Commissioners.

The Commission is an independent body that provides an effective alternative to lengthy and costly court cases. Under our terms of reference, the Commission has authority to conduct inquiries into specific claims when the government has breached an agreement, treaty or statute, such as the Indian Act.

For many years now, we have been calling on the federal government to reform the present land claims system by setting up a permanent, independent claims body. We are encouraged that change is on the horizon and we are eager to collaborate with all parties to ensure that a fair and just system that works for both First Nations and government is put in place.

As you browse, you'll see that the Commission's approach to claims resolution is based on building trust and respect between First Nations and the Government of Canada. Our inquiry process brings the parties together face-to-face, often for the first time, and respects First Nation traditions by bringing the Commission to First Nation communities to hear oral evidence from Elders and community members. When possible, the Commission provides mediation to help the parties resolve a claim without going to a full inquiry. To date, this approach has led to the negotiation or settlement of 17 claims.
