Government of Canada introduces new contracting advice to address privacy concerns

The Government of Canada has completed a comprehensive assessment of privacy concerns related to the transborder flow of data. The findings of its assessment are available in a final report, entitled Privacy Matters: The Federal Strategy to Address Concerns about the USA PATRIOT Act and Transborder Data Flows, which assesses the privacy risks associated with contracts that are already in place across 160 government departments and agencies.

In addition, the government has developed a guidance document for federal institutions to consult during the early stages of the contracting process. The document provides a privacy checklist and up-front advice for departments and agencies to consider prior to initiating contracts. It also includes advice on developing specific privacy protection clauses that can be included in Requests for Proposals (RFPs) and contracts.

The federal government is mindful of its responsibility to protect the privacy of Canadians while respecting international trade agreements and contractual arrangements with its suppliers.
