Ontario Company Fined $5,000 for an Offence Under the Food and Drugs Act

A conviction was registered against Pure Hothouse Foods Inc., in Provincial Court in Leamington, Ontario on July 11, 2006. The company was fined $5,000. The fine was the result of a guilty plea to one count of violating the Food and Drugs Act.

In July 2004, a Canadian Food Inspection Agency inspector visited the premises of Pure Hothouse Foods Inc. in Leamington, Ontario. The inspector found sweet bell peppers, which originated from the Netherlands, being packaged as “Product of Canada”. The company’s action was contrary to section 5.(1) of the Food and Drugs Act.

Section 5.(1) states:

No person shall label, package, treat, process, sell or advertise any food in a manner that is false, misleading or deceptive or is likely to create an erroneous impression regarding its character, value, quantity, composition, merit or safety.
