Reconsidering Privacy and Confidentiality in the TCPS

This is an open invitation to participate in a consultation on evolving the Tri-Council Policy Statement: Ethical Conduct for Research Involving Humans (TCPS) to be more inclusive of the full diversity of Canada’s research community by better meeting the needs of Canada’s Social Sciences and Humanities (SSH) Communities with respect to privacy and confidentiality issues.

The deadline for receiving submissions is 10 April 2006 (extended until 10 May 2006) at sshwc@pre.ethics.gc.ca or fax: (613) 996-7117.

Background
The Interagency Advisory Panel on Research Ethics1 (PRE) is a body of external experts established in November 2001 by Canada's three Federal Granting Agencies (Canadian Institutes of Health Research, Natural Sciences and Engineering Research Council and Social Sciences and Humanities Research Council), to support the development and evolution of their joint research ethics policy the Tri-Council Policy Statement: Ethical Conduct for Research Involving Humans (TCPS). The Agencies’ commitment of keeping it a living, or "evolving", document and respond to new research developments and identified gaps in the Policy resulted in PRE’s mandate of advising the Agencies on the evolution, interpretation, implementation and educational needs of the TCPS. PRE's independent and multi-disciplinary advice is intended to promote high standards of ethical conduct, advance the protection of human research participants, and enhance accountability in research ethics.

Social Sciences and Humanities Research and the TCPS
To fulfill its mandate, the Interagency Advisory Panel on Research Ethics (PRE) has established a number of working committees, including PRE's Social Sciences and Humanities Research Ethics Special Working Committee (SSHWC)2 in November 2002. SSHWC's mandate is to provide advice and recommendations to PRE on (a) priorities, and (b) methods and strategies for coherently addressing priority ethical issues in social sciences and humanities research involving human participants and (c) to co-ordinate and oversee the development of identified SS&H priority issues for social sciences and humanities. Consistent with PRE’s first principles, SSHWC’s work is based on principles of transparency, community engagement and consultation.

Privacy Issues and Community Input
As a result of consultation in 2003 and a consultation report in 2004, Giving Voice to the Spectrum3, SSHWC has developed a work plan that includes the development of a discussion paper on Privacy and Confidentiality research ethics issues. SSHWC now seeks input and feedback on the discussion paper from the research ethics community affected by them, including researchers, REB members, research ethics administrators, research participants, and other interested parties, to determine their appropriateness as well as to ensure that they do not interfere with those approaches and areas that are already addressed in the TCPS. Comments from the research community will assist SSHWC in drafting policy recommendations for consideration by PRE on privacy and confidentiality issues that may require (re)-consideration in the TCPS or complementary initiatives that may assist in the implementation, use and interpretation of the TCPS. The Committee welcomes your commentary on these and other issues that you believe are important for them to consider. The Committee invites comments on the specific questions listed below as well as any comment that may assist it in its further steps.

Next Steps
The next steps include consideration of the comments, drafting of recommendations, and public consultation on the latter.
