Competition Bureau seizes sunglasses with misleading claims

OTTAWA, July 8, 2005 – Consumers will not be misled by false or unsubstantiated claims on a shipment of eyewear following the Competition Bureau’s seizure of 15,000 pairs of sunglasses imported by an Edmonton-based wholesaler.

In May 2005, Bureau officials, acting on information from the Canada Border Services Agency, inspected a shipment of sunglasses from China intended for Gift Cave Corp. The glasses were labelled "Made in Canada" and "UV400 protection". The Bureau asked Gift Cave to provide documentation substantiating the claims, which they could not. The seizure was made pursuant to section 7(1) of the Consumer Packaging and Labelling Act (CPLA) for the misleading "Made in Canada" claims. Further, failure to substantiate the "UV400 protection" claims raised concerns under s.74.01(1) of the Competition Act.

Gift Cave agreed to comply with both laws by removing all the offending labels in question. The products were re-inspected by Bureau officers and released from seizure.

"This seizure is a clear example of how the Bureau works to ensure that consumers are not misled about the products on which they spend their hard earned money," says Raymond Pierce, Deputy Commissioner. "The Bureau will not hesitate to use all tools at its disposal to promote a marketplace in which consumers can have complete trust and confidence."

In 1999, the Competition Bureau issued the Guide to the Consumer Packing and Labelling Act and Regulations. This guide provides an outline to the packaging and labelling requirements for prepackaged non-food consumer products subject to the CPLA and the Consumer Packaging and Labelling Regulations. In 2001, the Bureau clarified its interpretation of the "Made in Canada claims with the Guide to "Made in Canada" Claims.

The Competition Bureau is an independent law enforcement agency that promotes and maintains fair competition so that all Canadians can benefit from competitive prices, product choice and quality service. It oversees the application of the Competition Act, the Consumer Packaging and Labelling Act, the Textile Labelling Act and the Precious Metals Marking Act.
